Recently, you posted a thread regarding a critique of your website, which I would have gladly done. I am always down to help out a fellow NSer. UNTIL, I found this on your website, my video, posted on YOUR Vimeo account with YOUR logo in it. Here it is:

You didn't even have the decency to ask me to use MY video which I spent MY time and effort editing? Why did you give yourself credits for editing when all you did was post your logo and switch one or two of the titles in the edit? Were you sitting beside me when I was cutting that edit? No. Also, by just giving me credits as a filmer and editor, you make me look like a filmer for YOU, which trust me, is something I would NEVER do. And by doing that, you are ruining MY reputation. This is really fucking low, and you should really think about what you've done. I'm done.

PS: Your logo is pretty shitty, and takes away from the video.
 
They Pm'd me asking me if they could have lucas as a "team rider" and I knew that meant re-uploading my video with their poorly designed "96 legend films" branding, even though they had no part in the production or creation of the film in anyway, they just want to be involved even though they did none of the work which brings me to the question; where these people rejected by their parents at a young age? These vicarious fucks seem to have no limits if they just did it regardless of your permission
That being said, If you didn't give them permission to use the video than someone else must have. Kyle, foaming from the mouth upon hearing the word sponsor, must have been very keen on the inclusion in their little team because perhaps he too was not loved as a child? Im not sure but that is the only reasonable explanation I can come up with right meow.
 
I mean, I suspect that to be what happened, but Kyle didn't talk to me about it either, so I'm not TOTALLY sure about what's going on. I'm just going to assume that's what it is for now.

kyle giving permission is the best explanation i can come up with as well, but regardless, bayarea still has to ask the filmmaker for final permission imo, since it is his content.

im just gonna copy and past my reply from the other thread in here to reiterate:

come on bayarea, you are hands down the laziest editor i have ever seen. try producing your own content dude, just having random kids send in footy doesn't make you or your 'team' legit at all.

and posting a kid's edit without asking permission is really not chill, especially because it makes his name associated with yours, as nik said in his thread. additionally, this is how the credits read on your website: Editing: Colin Johnson & Nik Lampard. you put your name first?? seriously? because you put a logo and a couple titles on it? you don't get an editing credit at all for that. taking somebody else's edit and putting your own logo on it is not editing in any way. get your shit together man, hopefully this is the beginning of the end for 96 legend films to be honest...

i'm not saying you should stop editing or anything, but this whole 96 legend thing has been bad idea after bad idea. you should just scratch the whole project and start over. and by start over i mean actually go outside, film, and do your own editing. this stealing footy thing is weak (i have to imagine that maybe kyle said 'oh yeah use this edit,' but you HAVE to ask the filmmaker, he's the one who actually made it).

i live sorta near him... hes friends with a kid i met on the east coast and im pretty sure hes like 12. but this is just reatrded, he needs to give up
 
He did you give credit at the end. I'm not saying he's right but it seems like he wasn't trying to piss you off.
 
I wouldn't have cared if he just posted my video, being the one I filmed and edited. But he took MY video, downloaded it somehow, put a few titles and logo in, and posted it on his account without my permission. I don't care if he gave me credits, he still stole it from me.
 
Some honest advice- you need to 100%, straight up quit this 96legend films bullshit. Let it die. Let everything involved and every thought regarding the concept of your company straight up dissolve and go to the end of the world, and dont ever let it resurface again.

Like Will said, go take some time to actually film, edit, and produce what can eventually be respected pieces of work. your fucking yourself by taking short cuts and abusing other's hard work. you will never be respect, especially in this industry, by stealing from others.
 
Looking through the rights involved and such, I could technically charge him anything I wanted. Granted, I'm not a dick, so I won't be harsh, but I definitely want to teach this kid a lesson.
 
Since I suggested the idea, I get 5% of all fines collected from the defendant. Sound good?

Send him a message though, let him know he is crossing serious legal territory that could cost him and his family a lot of money. Of course you could send him a cease and desist (end 96 legend films for good) letter, or just a warning.

i think it really depends on the age of this kid. i cant see him being very old, so he might just be a dumb kid doing stupid shit with his parents money, not knowing anything about what consequences he could be getting himself into. with that in mind, i think you should warn him, tell him to take his shit down, and if he doesn't then maybe make the next step into legalities.
 
If he's 16+ then I will definitely take legal action, because by then you have to be conscious of what you're doing. Say, 12-13 (highly likely), then I'll let him off. But either way my video will come down.
 
Well, judging by the name of his "production company", I would be willing to be he is just about 15 years old.
 
kid is a pretty chill kid dude so im sure it wont be a problem to take the video down, but you also might wanna have a talk with your buddy Coxworth because he said in the other thread that it was his fault because he gave him permission to use your edit...while i understand that he should have contacted you and everything because you were the creator of the edit, the kid is young and made a mistake and im sure he meant absolutely no harm by it. So saying you are going to take legal action IMO is taking it a little too far because he prolly thought that since the rider gave him okay, it was okay for him to use the edit, but that is just IMO

After talking to Kyle, Kyle gave him permission to show the Youtube video of mine, not to totally rebrand it with the 96 Legend Films logo in it, and even Coxworth is talking to him on that one. He also had no part in the making of that edit, also giving away false assumptions that he helped edit it. That's where the Copyright infringement lies.
 
This seriously won't go to court, it costs so much to settle shit in civil court, and I don't think either party wants to do so. It really just sends a message that this isn't something to fuck around with. That's why people always credit the artists in their edits or shorts (or should) so that way they don't run into copyright suits.
