Bitch hit me, no insurance

So this past weekend, me and a friend are just cruising through town in my suv. I'm making a left turn at this light and as soon as I start to turn, blam this bitch comes flying through the intersection, runs the red light and hits me. It hit the drivers side rear wheel and fender, and spun me around pretty good. (This also happened right it front of a police car and ambulance, both of which just drove past and looked the other way) No one was hurt, but I had to tow my car and she was still able to drive her car away, with a ticket of course.

Now here is where it gets shitty: I call her insurance company, give them all the info, and file a claim. They file it and call me back today, only to tell me that her policy was cancelled in February...fuck.

So now I'm stuck without a car (I have to borrow one), and without the means to get it paid for (I'm not filing a claim with my insurance, no way in hell my rates are gonna go up for this bitch), and probably have a lawsuit on my hands now.

Cool story, I know, but I'm raging mad right now. Anyone with similar stories? What should I do next? discuss
 
do you have no fault insurance as part of your policy? it covers exactly this situation. you should check it out first.

or take her to small claims court after your car is fixed.
 
I feel ya man, when I was down at school in Arizona my freshman year, my room mate had spent 3 years saving up for an M3 (not brand new, but it was sick), had it for one week then a illegal immigrant who was drunk rear ended him doin like 40. Car was totaled and the cop said that all they could do was deport him and he was SOL. Sucks man + vibes and hopefully you can reach a settlement with the girl soon.
 
your insurance shouldnt go up, you were in the clear

either way, watch some day time TV and wait for those lawyer commercials, call them, get money, etc.

fuck people who dont have car insurance, AND have the nerve to run red lights. Completely selfish
 
I'm not sure, I have to look at my policy again. Its just gonna suck shelling out money from my pocket to fix it when she should have the insurance/money to pay for it, and goin to court sucks, but if it must happen, I will.
 
yeah i wold def check it out. you can probably look it up online without even having to call them. i would check that first before reaching into your pockets, court etc..

exactly man. and I already had 4 medical places call me this morning to see if I wanted to come in and get checked out for injuries...maybe my back should start hurting...but since there weren't any injuries idk if those daytime ppl can help
 
I know I have Uninsured Driver coverage on my insurance policy for this situation - doesn't add much to a premium but saves a world on hurt in that situation...
 
Its gonna be a big lawsuit then, this bitch weighed more than me and my friend combined, I mean complete whale lol. But I will only if it comes down to that, my insurance company is looking into it now...

No. I was heading through the intersection, going to make a left turn, she was coming down the street to my left (heading the opposite way I was turning to), ran the light and hit me
 
alright this is what i was thinking but then i thought of how there are always left hand turning lanes? were you in a right lane turning left and she was in the left lane going straight?

I was on a one way street in the left lane, but that wouldn't matter. she ran the red light coming from my left, and turn lane or no turn lane shes gonna hit my drivers side
 
just go through your insurance company, i'm almost positive your rates won't go up if she is at fault. i just got rear ended a few weeks ago and was gonna go through the guys insurance company but they didn't total it and mine did. so i went through mine, they're getting the deductible back for me and no rate changes. look into it.
 
yeah man +vibes, its a sticky situation, if she doesnt have insurance, she more than likely doesnt have the money to give you to fix it, and im not sure about your rates, but i think as long as you have a witness testimony saying it wasnt at all your fault, you can file a claim with your insurance company and your rates wont go up
 
I have been in a few accidents. Here is how I would deal with it.
1. Contact her and ask her to pay the damages. Send her the shop quote and the rental fee's so she has an idea how much it is going to cost. Most people are reasonable and will just pay. I hit a car once and left a note on the windshield. Later we sat down over a coffee, I apologized and agreed to pay for everything in cash so my insurance would not go up. Everything was fine, she even sent me tickets to a free dinner/movie date for being honest.
again people are usually reasonable, just calm down and stop calling her a stupid bitch and you will probably have way less work to do

2. If she does not agree, tell her if she doesn't pay you will sue her (do not threaten to sue, just let her know where you will go next) . Also if you sue, let her know that you will have a rental for way longer (say your car is not being repaired until your situation is dealt with.)
3. If you have to, sue her.
Glad you are both OK. Traffic accidents suck but are not the end of the world. Just keep your cool and you should be fine.

You could sue her....but your insurance should cover it. It wasn't your fault, if anything the insurance company will sue her for the money.

What state are you in? If she got the ticket, it wasn't your fault so you won't get any hikes on your insurance or anything like that, you will just have to pay the deductible.
 
not trying to sound hard but if nothing comes out of this at least you have her address and could make sure she doesnt drive for a while by fucking her car up.
 
I would call your insurance agent right away. Hopefully you have a good one, and they can advise you on what to do. Obviously you're not at fault, and your rates may or may not go up, but they can tell you that. You'll probably have to shell out your deductible, however depending on how much that cost you, you could take her to small claims court to recover it.
 
You should 100% have uninsured driver insurance. There is a small chance you do not, but it is pretty unlikely.
Now just hope you have a low enough deductible. If anything happens to my car I still have to pay the first $1000 of damage.
 
You could sue, but odds are it will be pointless.

Most people driving around with cancelled insurance are broke to begin with.

my buddy got hit in what sounds like a very similar situation. luckily the kid had insurance. my buddy got paid out about double what his car was worth.

then his dad decided to buy him an Audi. hes a lucky SOB
 
well i have a somewhat similar story.

Today i found out that this asian fucker decided to sue me. last year i rear ended him cause i was merging then traffic stopped. yes, my fault. i asked him if he was okay once we had pulled over, and he said that he was fine. a couple months after that i found out that he was considering filing a lawsuit cause his back started hurting. this was two months after i had hit him. hes a fucking lying bastard (keeping in mind that i couldn't have possibly been going more than 10 mph after slamming the brakes for a while). so the marshall showed up at my door today saying that he is suing(sp?) me. im pissed and hes a dick

and thats my rant
 
Same thing happened to my mom, some guy tryed to sue her for 3 million dollars for hitting him or some bullshit. The reason was because after the accident the guy got hurt and couldn't work for 2 years or something(Complete fuckin lie), but it turned out that it was just a scam to get money out of the insurance company
 
And so we will destroy this asian/mexican douchebag. You will fight to the death in the court of law and you will win and counter sue him for being a cunt. Pretty sure you can do that these days... I dunno, worth a try.
 
Thanks guys for all the help. And for those of you wondering, I live in Ohio, where it is illegal to drive uninsured, not sure if it's a felonly but deffinantly illegal.

UPDATE: I talked to my insurance company last night, and I do have uninsured driver coverage, so I'm good there and will only have to pay the deductible at most. Also they are going after her for everything, so I may not even pay a cent. She will lose her license, maybe get her car impounded (haha she told me after she hit me that she just got it out of impound the day before), and if she can't pay they will most likely garnish her wages and whatnot. The last thing I want to do is go to court, but if it comes to it, I will.

And to the dude who hit that asian bastard (no offense to asians), thats just messed up that he would sue months after the accident. I got called yesterday by 4 doctors asking if I was ok and if I wanted to be checked out for injuries so I could get a maximum settlement. If he was hurt from the accident he should have gotten checked by a medical official within a week to prove it was cause by the accident, other than that I don't think he could prove it was cause you hit him. Anyway, good luck, and get a good lawyer.

I got hit by this asian bitch you rear ended up going like 70 while I was in the backseat of my friend's car, I have yet to see a penny in compensation from the scum at Mercury Insurance. First they tried to pay me off with like $200 before I knew my medical expenses. Now they're trying to give me $1700, which is still less than my medical costs. This happened in November of 2008, I've finally had to hire a lawyer to sue that bitch's ass.
 
i hit a 100,000 dollar caddy but she was parked in a no parking zone behind my spot so she got fucked for it. im that asshole, but fuck her im a poor college kid and she was rich and shouldnt have parked me in.
also, this weekend i got drunk and fell down a flight of stairs and wouldve had a 6000 dollar bill but my new policy passed the day before it happened.
sorry that is like the opposite of what you asked for.
 
this for sure. i didn't have insurance for maybe two months and i was definitely the safest driver possible.
fuck that stupid bitch.

I once rear ended an illegal immigrant's POS civic with my work truck and fucked her shit up, but my truck was fine, not a single scratch, she asked for money, straight cash, i said i'm calling my insurance and the police. she freaked out, got deported.

haha yeah we could, but I don't wanna have an assualt charge/restraining order on me or have NSCP charged with gang activitiy, and yeah dude last weekend to shred. And yes it is illegal to drive uninsured, legal action is pending.
