to some of you this may come as good news cause it sounds like a lot of people dislike us but we can no longer go on with Exodus Headwear because of a SoCal skate company Exodus Clothes.. they own this mark and are an established company so for the future of our headwear company we feel its best to change our name even though we've put almost 1000 bucks into EH already.. we will have a new name soon but you can still buy hats from us, they just wont have a logo yet.. speaking of logos, i would like to appologize to everyone who entered the logo contest because we cannot pick a winner now.. the winner would have most likely been jacob wester but we will be holding a new contest (with an extra prize along with the free hat) that will last only 1 week so that there's no delay.. sorry for the inconvience and wish us luck!!! (unless you hate us)

in the EH Update thread someone told me about them so i e-mailed them a few times and just for the future of the company, it would be better to change names now than later even if we do have shit already printed.. oh well :'(

you always have to check that, i suggest hiring a trademark attorney, you have to check that shit, also because of this it took us like six months to come up with a name so much is taken, in fact i am concerned about two manufactures,

 
I suggest you learn more about business and educate yourself before you make another costly mistake. It is obivious you really don't have a background in business. For example not doing research, not having an established website, poor ordering forms (aol), most likely not having business accounts, etc.

becoming a business isnt all that complicated...find a name, copyright it, declare yourself a business in the eyes of the IRS (or dont, haha its up to whoever to decide if u want to pay taxes..cause i dont think these kids are gonna get stung by the IRS, unless they like ns.com)

you need to make a business plan before worrying about what name you will use. that's like finding a window on the side of the street and deciding to build a house around it . or naming a band before before you even have one. Go to a textiles trade show and check out all the product. the more options you have the better. I am really curios as to how you spent 1000 on your logo???

Just for the record...you cannot copyright a name, only trademark.

AND YOU CAN HAVE THE SAME NAME AS SOMEONE ELSE EVEN IF THEY HAVE IT TRADEMARKED YOU JUST HAVE TO BE IN SEPARATE INDUSTRIES IF YOU DONT WANT TO GET INTO LEGAL TROUBLE.

All you have to do is call up the trademark office (in washington dc) and they will tell you everything. There is also a government website that has a list of every trademark that is still withstanding.

Believe me, i have gone through all this before. Like someone said, educate yourself. Its not that hard. Also, I really wouldn't worry about trademarking anything for a year or two as you are just a start up company and it is a lengthly and costly process. You have to apply, which costs money, and wait a long ass time. I wouldn't worry yourselves with too much business bullshit, just focus on making hats and rocking out.

But just for the record, if you and poniverus ever get in a gang war, you guys better be prepared for an upset! haha!

^ i already understand that but we arent only a headwear company.. we do sell t-shirts and sweatshirts etc.. but do you think that if we only did like 1 or 2 tee's and 1 sweatshirt that we would be labled under Headwear? or would that be under general apparel?

we're calling the trademark people today to try to patent Exodus Headwear if we can but if not i think we're going with Enigma Headwear just to keep ya updated
