What doesn't make sense?
In this case the company's (Enbridge Inc.) pipe burst. Its yet to be proven but looks as though it burst because the pipeline was too old and wasn't properly maintained.
They are now being sued in class actions for negligence and nuisance.
I am wondering if there are any viable defenses they can use to prove they are not liable for the damages they caused? Obviously it will be very hard for them to prove that, and there's no way it will ever get to a court room but I need to know if there are any possible defenses to negligence or nuisance that they may use should it reach court.
