Any chance to sue Rossignol and get somewhere?

So long story short, I broke my fibula skiing "Livin' The Dream" up at Snowbird about a month ago. The break came when I started tumbling and my right ski didn't come off. Thinking back on the day, I had at least one other rough fall that day where the same ski didn't come off when it should have. I have all Rossi equip ('05 Scratch Sprayer BC's, Scratch 120 bindings, and Rossi boots). Anything I can do? I'm really just bummed out that I probably won't be back to ski this season. Anyone have a story on how long it took them to come back from a fibula fracture?
 
Ummm, if the binder was DEFECTIVE and that is why you got hurt...maybe, otherwise most likely not, they didn't mount or set your bindings, and if you touched them yourself, there's no way you're getting anything from anyone. Let it be, take your time and heal up strong for next season.
 
Funny you should say that, in the Netherlands a women broke her leg during her first day of skiing, sued a rental store and (I'm not sure) Head for the same thing, the rental store didn't even change the DIN settings because the lady had an average build and they always keep their settings below manufacturers recommendation. Judge's verdict: "Serious injuries are risks you submit to when skiïng." - word!

Though, sucks you broke your leg. Get better soon!
 
you don't ski in Holland, silly. well, maybe cross country. you can ice skate though. if you want to ski, you go to the alps, it;s not very far away. dank u wel.

Frivolous lawsuits, a teacher of mine hates them. That does sound like a pretty dumb idea, shit happens. It sucks but what can you do?
 
you cant sue for you getting hurt, its assumption of risk when you're skiing. How would you prove your story? How would you prove anything? I cant stand fucking people, sue cause you got hurt skiing, fuck you man, thats how people kill shit, man up and stop bitching like the rest of us with injuries
 
no chance when you buy any equipment it is done under the understanding that skiing is a dangerous sport and injury can ocur blah blah blah long legal bullshit

but pretty much unless you could prove the company was blatently neglagent in the production of their product with some sort of defect that caused you injury u have no case
 
I wish i coud slap you, you deserve it. You broke your leg because you fucked up, and it sounds like you set your din up higher which will void anything you try to do.

I just broke my clavical (thats collar bone for the slow NS'ers) what am i suppose to sue heavenly now because I'm hurt, NO. I was the one who tryed the rodeo off the kicker box.

shit happens, your not the only one who has broken their leg skiing, it's annoying but just accept it, blame yourself not everyone else, you might get further.

Wow guys. I kind of expected this sort of response. Anyway, the only reason I even considered seeking some sort of legal recourse was because I thought one of my bindings might have been DEFECTIVE. That same binding did not release on previous, hard falls that day. For the record, I never touched the settings on the bindings. Now ... of course I realize that simply falling and getting hurt is no reason to sue--that would be ridiculous and would warrant all the high-horse replies this thread has received. However, if the binding is proven defective, maybe there is something to go on. Although I admit that even with that proof it would be a long shot.
 
so go ahead, pay thousands for a lawyer, what are you telling us? You heard the shit we had to tell you, if you want to be a shmuck, go ahead and sue, you're going to lose anyway
 
what's funny, is that this actual train of thought ONLY occurs int he USA seemingly...

people only sue in the rest of the world when they're actually not at fault...

they didn't fuck up

bindings are designed to make skis stay on yuor feet hense the name bindings

and they don't always release could just be the point of impact on the boot or ski wasn't enough to make it release
 
i have my bindings set to 8 and i have taken sone pretty nasty high speed ligament tearing falls where neither ski releases. it happens. get over it. go ahead and sue but come back and tell us how much molah you loose in court fees and the expense of a lawer so we can laugh at your stupid ass!

um, no im not from canada, nice try though, but on a serious note. If you had concrete evidence that your binding was malfunctioning, than you probablyw ould have a case. But, the problem is you really don't. I believe you that it may have malfunctioned, but a court would not. It would definitely not be worth it because the court fees and lawyer fees would be multiple thousands of dollars. So although I may have been a bit blunt, but i really dont think you have a chance
 
no chance unless you can prove that there is something wrong with it and you got hurt as a result of neglagence

so if they knew this was a terriable system and it never releases and they still sold it

then yes maybe you could try

even then rossi=lots of money

you = not so muhc money

i fractured my fibula last year. i had no cast, just a boot walker. i was on crutches for about a week. i was skiing in 6 weeks. i coul have probably skied in 5 but i was playin it safe
 
i agree with u why the fuck would u sue.when i tore my spleen last year the insurance compian sent a sheet asking i wanted to sue the ski compian(armada) and sue the mountian i just took the sheet and threw it in the trash.
 
broke my tibia and fibula and was out for 3 months but thats cause of the tibia. i dont knwo about fibulas. my fibula is 50% off set. its great!
 
why would you continue to ski on a binding that hasn't been releasing? I'm pretty sure you should have gotten it checked out.

It sucks you got hurt and I hope you get better, but I don't think you would get very far.
 
even if it was partially their fault (which its not), rossi is a huge company that would rape you in court with a team of hot shot lawyers. sorry but you lose
