9 months probation for possession of marijuana...

had court yesterday and i got 9 months of non reporting probation for possession of marijuana. I had like 2 grams on me btw. do you think this is fair, or do you think i got fucked over?

also like i said that sucks but i guess at least youre not paying fines or anything right
 
You got fucked over, but it could have been worse. I've been fined like three times for it now, about a gram or two every time. Every time I've gotten just a written citation and had to pay a fine of about 350 bones.

Actually if you didn't have to pay a fine, I'd say you made out well.
 
look at it this way, it could be a lot worse.
non-reporting probation....so that means what...you just have to not get caught again? could be a much bigger pain in the ass man, just be happy it's not that bad and learn from the experience
 
i realize that i broke the law, and that i must be punished for it. it is a law that i don't agree with, but i am accepting the punishment like a man. i question the fairness of the punishment, because the average probation sentencing for this sort of crime is 3 - 6 months.
 
thats the way i am looking at it. just gotta law low. my probation officer said that if i complete the first 6 months without any issues she will request the judge to re-evaluate my probation and let me off early. i feel like even she was surprised that i got 9 months.
 
Is it a first drug related offense? Have u had an mip? I dont think it's a ? Of fairness either way. The judge has the descretion to punish as he sees fit. U broke the law and im sure prob of any length isn't the worst possible punishment for that crime. It's not like he threw the book at u
 
i've already gotten so used to the worst case scenario being a $100 fine (live in mass- decrim) i feel bad for you guys. hopefully soon
 
that's good at least. but again, sorry to hear it man....i've had to pay fines for stupid tickets as well and it's so frustrating having to throw away money like that. in the long run though, $600 is nothing and you'll be fine.

one of my friends got a year of probation with weekly drug screening for doing exactly what you did, also in Michigan. they let him off after 7 months though so just be good and you'll get through!!
 
don't feel bad. it's the fault of the person with the weed.

don't smoke in places where you can get caught. don't drive with weed unless absolutely necessary. don't smoke in your car. don't stop and smoke in public places, keep moving and if possible be near enough to a crowd to blend in if necessary. last, but not least, know your rights.

I've gotten incredibly lucky in the past, but I've learned that you can't feel sorry for yourself...like the OP is doing, see it as it is and be careful.
 
just don't smoke for a while. it's best to keep yourself clean until your shit's over because if you get caught again your ass is fucked. well not really fucked but it will be a bitch.

 
yeah i have already gone 18 days with out smoking, and dont plan on starting up again anytime soon. i will when i get off probation though
 
no in the state of michigan there is the 7411 act. if you are a first time offender, and make it through probation with out any issues, the charge comes off of your record.

You got fucked. However you should consider yourself lucky. I got pulled over in the most conservative county in Montana with a little under 2 grams on me and a pipe. I ended up with 6 months supervised probation, mandatory drug classes, and a $585 fine. Not to mention the two times I went to court was a 7 hour round trip.

My probation officer was really cool though. We talked about skiing, he almost slipped and told me a party story. LOL. He never tested me either.
 
yes if weed is illegal in your state you smoked it, and got caught. move to ny CO or ca where its decriminalized if you want to smoke.
 
no problem. 6 plats w/out a medical card is just a misdemeanor too.

Slow down. Sometimes the mature, educated smoker response fails in situations like this. First of all, the OP wasn't arguing fuck the police, I got busted, he was merely asking if he got fucked over, not necessarily by the long dick of the law, but just in general. And yeah, he did kinda..9 months probation, granted unsupervised, is pretty wack. $600 fine? Definitely wack. I didn't even know shit could be like that. In Albany? Slap on the wrist. New Paltz? It's like a 30 dollar fine. Second of all..I don't just smoke weed in my mom's basement after middle school. Now, I know you, SirFynator, as much as another Newschooler can generally know another Newschooler. I know you are not smoking weed in your mom's basement after middle school. But where are you suggesting that people smoke? "Not anywhere where you can get caught.." What? It's illegal pretty much everywhere..So only in the crib? "Always try and keep moving, blend into the crowd.." What is this, a stealth mission? I don't draw up a game plan every time I smoke a blunt. Maybe it's different in [Seatle, I believe?], but you gotta be real. If you smoke weed, you smoke weed. You're gonna smoke it wherever you are, whatever you're doing. I'll go ahead and restrict it to the very limited don't smoke if you're traveling with quantity of drugs in car; don't give anyone a reason the search the rest of the whip. Sorry for the rant, I rarely post, but sometimes I just feel the need to get my thoughts out
 
I can't agree that what you said is a good idea. I am always careful about where I smoke now. It's illegal. You do anything illegal you make damned sure you don't get caught, otherwise you're being ignorant and putting yourself and your friends that you are smoking with at risk. You don't want to get caught, you make sure you can't.

I also think that despite the 'harshness' of his situation (which I don't think is very harsh, unsupervised probation means that you're basically not on probation...) he is in exactly the same spot he was at before, with the exception of a petty misdemeanor that may or may not come up in a job interview. That is, if it doesn't get expunged by the end of the probational period.

Doesn't have to be a stealth mission, it's just being careful. It's not like you can just light it up like a cigarette.
 
I think it's bull shit because marijuana is better than smoking cigarettes, and they can legalize it, but when they catch people with it, they can fine you so more $$ for the government. I'm guessing that legalizing weed is just a waste of time, and how did you even get caught? I used to know a kid that was like 13 that sold pills, pot, and what not. I don't even know how you did get caught.

i wouldn't say that getting caught makes you ignorant, especially in a situation like this. marijuana laws are so debatable, and there are so many opposing viewpoints out there. one could argue that you are ignorant if you adhere to the marijuana laws, because there is nothing wrong with smoking cannabis. Personally, I value the liberal left, and the open-minded.
 
realy? in switzerland that would be a complete fuck over. here, u just get a warning for up to 5g. above that ur considered a dealer and get a fine/court case. As long as you dont get caught smoking for a week, the warning disappears and its as if notning happens.
 
Ignorant in the sense that you weren't aware of your surroundings, not your views.

Also, try not to apply any political stance to the legal status of marijuana...there are plenty of conservatives out there who believe it is a total waste of money and agree fully with the legalization.
 
the reason why i was hating on your original post, is because it was an extremely absurd statement that made zero sense. first, you started out by defending marijuana, and then you said that legalizing it is just a waste of time. you can't get anywhere if you contradict yourself dude. second, the government does not make more money by keeping the herb illegal. take a moment to consider all the money and resources, that our government allocates to the combat the "problem" that is marijuana. also consider how much money it took to arrest me; they had to pay two police officers, three jail guards, a judge, two court clerks, and a court bailiff. they also have to pay a probation officer to keep track of me. you really think that getting me to pay $600 makes up for the cost of all these things? you are truly foolish if you do. you should also take a moment to consider the amount of revenue that our government could collect off of marijuana if it was legal. I have seen research that suggest the our government could make $12 billion a year, off of taxing marijuana. if you want to know how i got caught, you can read my previous thread's regarding this situation; i explain the whole story. your comment about knowing a 13 year old who sold "pills, weed, and what not" is of no relevance, and is down right moronic; you sound like a 12 year old that doesn't know the difference between what is right and wrong in this world. you also have lead me to question your judgment; clearly you are trying to lecture me about getting caught, yet you admit that you associate with people who sell dangerous narcotics like pills and "what not". clearly, you have to re-evaluate your own judgement, and how your criticism towards me is distorted. if your 13 year old friend truly sold pills, and substances other than marijuana, than he is at wrong, and i hope that he can mature and grow into a citizen that provides positive contributions for society.

 
that SUCKS hard of course you got fucked over. In Mass you would only get a fine of $100 which you technically do not even have to pay and the weed will be confiscated and you will be on your way.

they coulda given you a year in jail..prolly more cause if i remember right you were driving at the same time and going through a stop sign.

Lol, United States. I know many people who have been arrested with weed in Canada. Shit is pretty much decriminalized.
