8yr old kid sued by 60yr old in ski collision

i know that the downhill skier always has the right of way...and whether or not the kid knows that it doesn't matter...but that being said, on every ski ticket or pass it says something along the lines of skiing is a dangerous sport, you are doing this at your own risk. everyone knows there are dangers when it comes to skiing...little joeys skiing into you being one of them. how hard could an 8 year old hit a 60 year old, who probably wasnt going too fast, so hard as to to compile $75,000 worth of medical bills. and that being said, health insurance should cover it, and if the 60 year old didn't have health insurance then he should not have been skiing.
 
how does jim chalat sleep at night there no difference between an 8 year old and a 16 year old. Ok i'm down for sending hate mail his way, whos with me.
 
i in no way advocate what i'm about to say (entertainment purposes only!), but: if you hit someone and can run, you probably should. this society has made the consequences so horrific that is isn't worth it to stay. You will probably end up in jail, have to pay ridiculous medical bills, and possibly ruin the rest of your life- from a ski accident.
 
this is a small point towards free health care. If this idiot didn't have to pay his medical bills he wouldn't have sued an 8 year old kid.
 
Well for starters, the kids suit will be thrown out. In the state of Colorado a minor cannot be sued.

EAGLE COUNTY –

An 8-year-old in Vail is doing something most people never have to

worry about. He's getting ready for a civil law suit against him.

Scott Swimm and is family live near Vail so his dad Rob says skiing has become a way of life.

"One of my favorite things to do in the world is take my two boys skiing," said Rob Swimm.

Then back in January while skiing together at the Arrowhead Ski Area near Vail, Rob says that way of life changed.

"Scott's going to have to be in court and he's going to have to be deposed by lawyers," said Swimm.

It

all started when Scott collided with another skier, 60-year-old

Pennsylvania resident David Pfahler, who's now suing both Scott and his

dad in District Court for $75,000 for a torn tendon, lost vacation time

and medical expenses.

"It was a minor accident that happened

on the slopes where Scott skied over the front of this gentleman's

skies, he fell back and seems to have injured himself so bad that he

needs to sue my now 8-year-old son, (who was) 7 when this happened, for

$75,000," said Swimm.

Scott's dad says he saw the accident and

says Scott was the uphill skier coming down a catwalk when he tried to

pass Pfahler. He says that's when the older man turned and stopped in

front of his son.

Pfahler's Denver based attorney Jim Chalat,

won't discuss the lawsuit or what happened, but does say his law firm

often deals with ski-injury cases like this, and that according to the

skier safer act, uphill skiers, like Scott, are responsible in

accidents.

"In regard to collisions, it says the overtaking or uphill skier has the primary duty to avoid a collision," said Chalat.

As for suing an 8-year-old child, Chalat says that a minor being taken court is not that unusual.

"In

this case there's some controversy because a child is involved, but in

fact this is nothing new. From a technical standpoint, it's no

different than if your 16-year-old is involved in a moderate accident,"

said Chalat.

Scott's dad disagrees.

"I think it's shocking that a 7-year-old is being put through what he's being put through," said Swimm.

He says like most kids his son knew nothing of the legal system, but is now learning about it first hand.

"Scott didn't know what the word 'sue' meant," said Swimm.

The Swimms and Pfahlers will first meet in court in Denver on January 7 for their depositions.

Despite

what Pfahler's attorney says, Colorado law states you cannot sue a

minor, so the court could dismiss the portion of the suit filed against

the boy.

there should be no such thing. when you purchase the lift ticket you know that shit can happen and you can get hurt. no sueing should be necessary. just like a football player sueing someone that hit them and caused them to break an arm or something like that. straight up retarded. Unfortunately they will just sue his dad for the damages.

In one story I read the old guy reached out and grabbed the kid by the legs and took him down after he said sorry and tried to ski away. So it is my conclusion that the old guy hurt his rotator cuff by pulling the kid down and not from the crash. If he let the kid go then he would have been fine.

The old guy is worthless though...who does such a thing. Also I tore my rotator cuff and you miss a week tops. I was going to school a few days after I got the injury taken care of. It really doesn't ruin your life. Hell my uncle is a contractor and he had surgery on it and was back to work in three days. He would have been swinging a hammer if I hadn't told him he couldn't.

wow after reading the article it makes me even more annoyed. they kid didnt even hit him...he skied over his skis....if the kid didnt touch him he has no case. ive had joeys ski over my skis before and not fallen. people are ridiculous.
 
This old fart is definately a douchebag. As noted above, having your skis run over is not a collision. There was no body to body contact according to this report. Now if the guy fell because he became unbalanced, that is reasonable. But, that type of fall would/should not destroy your shoulder. If it does, you should not be skiing. You are too fragile to be doing this sport. On another note, this guy should be stoned to death for putting this kid through so much trouble. The kid wont get sued, but his parents will and the family could go into financial trouble because 7 year old. If this guy wins, it just shows the flaws in the legal systems that we live in.

this is why i hate America, people are always looking for a way to get a buck, with no care what will happen to anyone else besides them selfs. i thought old people had more of a moral code then us young people do, guess not. I hope the state of CO laughs in the 60 year old mans face and tells him to go fuck off because you are going after an eight year old, and his father, which the father had nothing to do with it to start with.
 
It's an 8 year old. It's clearly a mistake. I don't care what you say or how good an 8 year old can be. It's a mistake and an accident. Yes it does ruin your vacation but look at it. He's 8 and your 60.
 
Anyone know where he lives? I vote we egg his house...and saran wrap his car, then run away cause he might sue for slipping on egg and loosing hearing from falling onto the car covered in saran wrap...
 
I'm sick of all these skiing lawsuits. Shit happens and you just gotta deal with it. When you buy a lift ticket your pretty much saying that you understand the risks involved with skiing so people need to stop being little bitches when an accident happens. My resort was seriously considering getting rid of gaps onto rails this season because last year some noob on rental skis thought it would be cool to try a six foot gap onto a box and ate shit. I think he broke his collar bone or something and his mommy tried suing the resort. Didn't hold up in court at all but still why waste people's time with that bs. I mean really come on, it was nobody else's fault just a stupid decision on his part. Skiing is a dangerous sport and thats part of what makes it what it is. If you can't deal with the risks you shouldn't be doing it.

$75,000 aint shit. It is so not hard to rack up $75,000 in medical bills, especially if you are without insurance. Nevertheless, I hate when people swerve in front of me on catwalks. If they get hit, it should be there fault for not checking over there shoulder. If soemone is passing you on the highway and you jerk into their lane and take them out I am pretty sure you are at fault, even if they are overtaking you.
 
yeah but the old guy would have to 3 years to get his surgery. anyways, if you don't have enough balanced to stay standing while an 8 yr old runs over your immobile skis, you shouldn't be skiing. the dad should countersue claiming the old guy was a liability and an accident waiting to happen.
 
the dad should counter sue for school time lost to be in court for no reason...cuz that might work! because the kid has to miss school to be there and he has to miss work to be there....
 
if someone ran over my skis id just be like watch the fuck out, or have them get me a new pair dont fukcin sue an innocent bystandard trying to have fun in the snow
