you can only be charged for trespassing in a public area if its after posted hours or something, say in a park, otherwise you can be charged with trespassing at any time if its private property.

otherwise i think they could get you with "vandalism" on rails in public

Just remember to be really nice and cooperative when they bust you. Usually "the authorities" will be super excited and all aggro when they first catch you, but if you say "I'm sorry" a ton and act innocent and just be like Beaver Cleaver, they'll usually end up letting you go with a warning.

But there is still no guarantee that you won't end up dealing with the guy who just lost his wife to a lesbian lover and is soooo pissed off that someone has to pay. If it's you, then you're fucked.
