10 year old kid almost chokes to death on chair lift

I don't know if this has been posted already but up in Park City today some little dude got stuck to the lift by his backpack and hung down from the chair for a minute choking, on his backpack. He finally popped off his helmet and fell about 30 feet. I guess now his family wants to sue. I think it's with good reason though. Isn't the chair lift operator suppose to be watching to prevent these things from happening?

 
no they shouldn't sue, how would that have been the resort's fault or even the liftie's fault? It probably didn't even happen right at the bottom of the lift anyway

chair lift people can only do so much like say take off your back pack but if the person doesnt take it off or cant before they get on the chair what then? nothin thats what. my guestion is where is this kids parrents probly off fucking in the bushs cuz it sure dont sound like there was anyone on the lift with the kid

Last time I checked, you were supposed to take your backpack off before boarding a lift. It's not the resort's fault that the kid is a posterchild for abortion.

hahaha^ i got levitated by my backpack once. really fun, i tell you. but his parents shouldnt sue. thats just dumb, for a dumb mistake that anyone could make. if the kid died, then maybe. but not if hes fine. people are so sue happy in america, its like ' oh lets go spill hot coffee on ourselves at mcdonalds, then sue them and get rich.' soooooooo stupid. sueing has its place, but it is overused for the wrong purpose

I'll have to agree, at least partially. The kid was 10? Yes, he is able to act on his own, but kids should be at least semi supervised and should def. be supervised if they have not mastered the rules of the hill, i.e. taking off your backpack.

The parents will sue, it will be settled out of court, they'll get their payout and the resort will step its regulation of said policies.

I would sue. Or at least try. For that kind of brush with death, especailly at ten. The kid seriously thought he was going to die, hanging, from a chair lift. YOu know you would be pretty shocked, and pissed. But I see what you mean about having some life skills. He wasn't the brightest...

why sue janibille? what does it do? it drives up insurance costs and causes prices to go up for the consumer. take responsability for your own fucking lives. if it is not gross negligence sueing only acts to hurt the rest of society. one person may become rich off it, but that person should die.

My question is how did he end up hanging?? Was it a t-bar or rope-tow or something?? I'm assuming by falling 30 ft it was a chairlift. How exactly does a backpack get caught on the chair?? Maybe I'm not looking at it right.

They get caught on the side seats. either around the chair pad or near the safety bar. I've seen it happen but it usually ends up that people just can't get off the chair.

Im a lifeguard, We put that shit up so instead of saving some fag's ass and taking the time to backboard them we keep our eye's on important thing's like how even our tan's our and if im getting to bronzed in the face. Not having saftey bars on chairlifts is etch, but i heard a resort in America got sued because some fat ass got caught in the saftey bar and was 'embarassed' so she sued the resort, so then the resort was told they had to take all the saftey bars off the chairs. Anyway over here in Australia some guy sued the local council because he went swimming at night when he had been drinking and popin pills and broke his back, anyway he sued for 4 million, it seems Australia just copies America these days

By purchasing a life ticket or a season pass, you assume all risks. That means if you choke on YOUR backpack because you didnt take it off on the chair you cant sue the mountain. Buy buying a pass or ticket, you basically signing the waver that signs your life away

haha ouch.. i saw something like this on this movie called death to snowboarders or something

it was about this raging skier person who killed all theses snowboarders for some reason.. it was pretty cool.. in the end the killer was some hott skier chick.I was dissappointed to see her die. But yeah.. relating that to thist event.. haha.. well in the movie the person ties this girls scarf to the back of the lift and she goes to get off of it and cant ride away and then it brings her back around and she hangs all the way back down the mountain.

i'm not saying the kid shouldn't have known better (or maybe he did, i see people on the lift all the time that are too lazy or whatever to take their packpacks off). but to some extent it was a total freak accident. i would want a little compensation. maybe he won't win the case, but what if he died there? the resort would close, maybe chair lifts would be re-engineered, who knows. at least bring it to peoples' attention so they can learn from it. just dismissing the whole thing as 'child stupidity' is a waste...

The kid was a retard, the parents were irresponsible in letting the kid take a lift by himself, as he clearly wasn't able to, and the lifty probably did what he/she could to get the kid to safely remove his backpack (like you always should when boarding a lift) and get on the lift safely.

i think it's just an unfortunate accident, and nobody's really to blame. they should just be more clear about not letting kids wear backpacks on the lift, with a picture of a little kiddo hanging from the lift or something.

doesnt the little message on the back of the ticket not let you sue? i remember going up the lift and reading the back of those. it said like the mountain is not responsible for any injury/death/possetional loss.....and you cant sue.

unless the liftie forgot to mention to take off the back pack, its solely the kid's fault. and i know shit happens, but there are rules for a reason. the mountain is a big playground. even though resorts seem safe, lifts are heavy machinery nonetheless. im sure the kid will look back at the footage some day and be happy it was a powder day and laugh it up
