Whistler Blackcomb Mountain Safety stealing a guys snowboard

I think more context is needed... with that being said, I'm not sure how stoked I'd be if a volunteer tried to confiscate my equipment.

^ ya im really curious to know what he did wrong. those patrol dudes are usually friendly but if you do something to piss them off or something that looks unsafe they get serious pretty damn fast.

so they took the dude in the white shirt's board when the dude in the blue shirt was the one freaking out? This makes no sense lol, hopefully the dude in the lame jersey in front of the cameraman also taking a vid posts it up.

That was the most boring 3 minutes of my life.

Wondering what he did. Were they trying to ride without passes? Smoking blunts in the lift line? On america's most wanted?

What's the story that's missing in the video?

Even this says absolutely nothing about what happened. I think it'd be hilarious if they tried to grab my snowboard. I would just take it back.

DONT READ

In this video we see what appears to be Whistler Blackcomb safety patrollers physically detaining a snowboard from a member of the public. It is unclear why the snowboarder is being physically detained by the safety patrollers but the YouTube description states “Whistler Blackcomb Mountain Safety workers taking their jobs way too seriously.”

thewhistlernews.com questions the legial right of the Whistler Blackcomb safety patrollers to use phisical force to detain a skier or snowboarder.

“This incident raises serious concerns about how much physical force the Whistler Blackcomb staff are allowed to use and how lawful the amount of force being used in the video dated May 5, 2013 is. None of the Whistler Blackcomb staff are active peace officers because they are not on duty by the RCMP and are employees of the resort. There are a variety of opinions about the legality this incident displayed in the YouTube video dated May 5, 2013 and why the snowboard is being physically detained. In the video the people who appear to be Whistler Blackcomb staff appear to be physically restraining the snowboard and not allowing the member of the public to leave with it. The return of the snowboard equipment appears to be denied towards the end of the video that ends before the incident finishes.”

The Criminal Code of Canada states the following about Forcible Detainer. laws-lois.justice.gc.ca

“Forcible Entry and Detainer ….

…. (2) A person commits forcible detainer when, being in actual possession of real property without colour of right, he detains it in a manner that is likely to cause a breach of the peace or reasonable apprehension of a breach of the peace, against a person who is entitled by law to possession of it.

Questions of law

(3) The questions whether a person is in actual and peaceable possession or is in actual possession without colour of right are questions of law.

Punishment

73. Every person who commits forcible entry or forcible detainer is guilty of

(a) an offence punishable on summary conviction; or

(b) an indictable offence and liable to imprisonment for a term not exceeding two years.” Criminal Code Of Canada – May 8, 2014

The Criminal Code Of Canada notes the following about Theft.

laws-lois.justice.gc.ca

“Theft

322. (1) Every one commits theft who fraudulently and without colour of right takes, or fraudulently and without colour of right converts to his use or to the use of another person, anything, whether animate or inanimate, with intent

(a) to deprive, temporarily or absolutely, the owner of it, or a person who has a special property or interest in it, of the thing or of his property or interest in it;

(b) to pledge it or deposit it as security;

(c) to part with it under a condition with respect to its return that the person who parts with it may be unable to perform; or

(d) to deal with it in such a manner that it cannot be restored in the condition in which it was at the time it was taken or converted.

Time when theft completed

(2) A person commits theft when, with intent to steal anything, he moves it or causes it to move or to be moved, or begins to cause it to become movable.

Secrecy

(3) A taking or conversion of anything may be fraudulent notwithstanding that it is effected without secrecy or attempt at concealment.

Purpose of taking

(4) For the purposes of this Act, the question whether anything that is converted is taken for the purpose of conversion, or whether it is, at the time it is converted, in the lawful possession of the person who converts it is not material.

Wild living creature

(5) For the purposes of this section, a person who has a wild living creature in captivity shall be deemed to have a special property or interest in it while it is in captivity and after it has escaped from captivity.” Criminal Code Of Canada – May 8, 2014

There have been concerns in the past from the public regarding how the Whistler Blackcomb safety patrollers engage the public. Incidents between the safety patrollers and ski or snowboarders can be viewed at times on the slopes. Many of the patrollers are very polite but some of them at times can be very vocal when engaging in enforcement upon visitors to the resort.

During 2013 Whistler Blackcomb resort installed new Family Certified signage in specific areas of the resort.

Regardless of context, without being official police I don't believe they can confiscate personal property legally. They could make someone leave the premesis, but they can't take your property afaik.

I bet JD would know for sure though.

seeing as they aren't cops, I'd tell them to get fucked and Id go home. if he was

riding like an ass, a pass being taken should be enough. Definitely overstepping their boundaries

why power trip when you can dance? more bikinis less yellow jackets please.

does anyone have a link to the news article that ns posted? cant find it anymore

fuck the killa bees, they are the most hated people on the mountain, they just stand at the bottom of the park waiting to take passes for people going "too fast". On the first day the new park was open, safety bob took like 15 passes or something.

they shouldve gotten beat the fuck up or at least thrown to the ground, thats crossing the line. Thats like a crossing guard trying to impound my car.....good luck

typical mall cop mentality.

I had a guy try to take my skis once, I told him "you can't just take me skis" and he gave them right back.

Then he called the state police.

Just curious, for what?

what the guy whose board was stolen said to make all this happen.

"yeah I was just doing a few buttering tricks on the run toward the terrain garden when there's NOBODY around on the run, and I got stopped and was told that no tricks on the green run."

My favourite trick of them this year was making instructors get suspended for a week, for something little timmy did at the back of the class, even after warning the kids not to break safety rules.

I will never work for this company again, i spend my whole season coaching safety to thousands of people new to the sport and a bunch of jumped up gimps make us all look stupid in the uniform.

Shame on you whistler, that's left and illegal detention.

They are also starting to delete posts off there social media, it looks like they are going to pretend it never happened.

Let's not let that happen.

Oh goodie! I love a good old social media shitstorm. Can't wait. Popcorn should be ready in just over a minute.

about 10 of these guys are standing around in a group at the bottom of the black park with a slow sign where the green run passes through the top of the new park extention down to solarcostar. all they do is yell and try to take passes. go through that section super fast and spray them.

can we organize a mass spraying/snowballing of bob lynch? haha just get like 50 people all come ripping through at once

Growing up skiing alta, I just can't fathom a bunch of safety patrollers clipping people for going too fast or doing tricks or something haha.

Those two same safety cunts took my skis and banned my pass for a month last season. His name is Bob. He's a fucking cunt.

They take your stuff to force you to come into their office and identify you,

i am not a fan of the safety people of WB. a lot of them are on a serious power trip, as you can see here.

anyone realised that the vid is over a year old?

Well if he had been warned and carried on its on him. I know that slope he is talking about, its where all the familys go to learn. If you get told no tricks just do no tricks. Get down to the park its like 30 secs.

But that vid is on whistler not blackcomb, so Im not sure I beleive his excuse as he is on the wrong mounatin to be riding the garden. So many people give the safty guys shit when really they are just looking out for every one on the mountain, which includes familys and beginers who may be put off by tricks ect. Most are good guys if you chat to them.

Actually that does look like solar not green, but Im still going to guess its mainly on the guy not saftey.

It is solar, the park goes all the way down to the bottom of solar for the spring.

Both the park and the garden? Which way did they bring it down? That always annoyed me on blackcomb taht the park did not finish at the lift. Whistler had a better flow top to bottom I thought.

lol why didn't he run there volunteers there not going to chase after him and why would they take it so serious he must of done something pretty stupid

they would have just radioed down to safty guys lower down who would have just pulled him over. He would have just made it worse for himself. Im guessing he just ran his mouth off at them. Those guys are fine as long as you do as they say which is not hard.

HAHAha! What the fuck?! I cant believe this happened! I cant even believe they are telling you guys, if you´re skiing too fast and take your liftpass for that.. haha, ridicolous!

Honestly I would just keep skiing and pack up for the day and head home. No way I would let some volunteers take my setup that's worth X amount of dollars. No matter what the guy did that just doesn't make sense and they only get power when you give it to them.

That wouldn't work, they'd radio down to the other people lower on the ski out and they'd get you and pull your pass. And then you'd have to deal with safety bob and that's the last person you would want to talk to..

Can someone with a Whistler pass on hand see if it says anything at all along the lines of 'if you are in violation of any mountain rules we reserve the right to confiscate your equipment until you leave the property'?

If there's nothing about that at all then what they're doing is pretty much theft.

Someone look into this, make sure it actually would be theft, bring the fuzzy handcuffs you have in your closet, ski really fast by them till they go to confiscate your gear, then have a couple other people come help out and make a citizens arrest on them for theft (this is legal, if they are indeed in the act of stealing your shit). Then call the cops and get them charged with theft.

Whoever does this (and films it) will be given eternal legend status. That's hilarious.

if it was an easy thing to do, it would have been done. they will follow you to the blackomb base or the village probably and when your taking off your gear theyll get you.

They will get you and what? what can they legally do? How could he take anything without physically "attacking" you? Absolutely no one, except a police officer, will lay hands on my gear without my permission.

come ski whistler, ski fast by mountain safety. See what happens.

Ski'd Alta for the first time a few weeks ago. Casual 45ft handcrafted table sitting in full view of the only main lift running and the base area. They roped the jump so non-casuals wouldn't stumble in to it and get rekt, but gated the in-run so you could haul ass and hit it.

I love Alta.
