Alright well it's not quite that simple. So for those of you who don't know what the current marijuana climate in canada is i will enlighten you.

This is how it is. in 2000 the court of appeal threw out the current (at the time) marijuana laws in canada, and gave the government one year to replace the law. They replaced it with the Medical Marijuana Access Regulations...but that only deals with medical marijuana and not every day non-medical use. That means there is essentially no current law in ontario.

Just last week, a judge threw out a possession case of a 16 year old guy saying that there was no law to try him against. So he let him go. Now for those of you with no legal knowledge, that sets a precedence which means that all courts must handle the case the same way or else you could just appeal it because you cant have the courts handing out penalties for a law that has been voided.

So, you will still get arrested BUT when you go to court you will almost for sure get off. At least until the appeal form Ottawa goes through, but i would risk to say that ottawa isn't going to stand a chance in the appeal process :-)

So anyways, spark up a fattie and celebrate to this one!

yeh but that will change as soon as a new law is in place... they will probably decriminalize it anayways (not legalize)

even when it is decriminalized, you still wont get off scotch free, it just means that you wont have a criminal record for a certain amount of weed...youll still get a little fine, so dont think you can run into a cop station and take a hit in the reception area or anything...

but that's the thing...they keep on delaying the decrim bill which leads many to believe that by not taking a stance on this, they are taking the strongest stance they possibly could against ASScroft and Bush's cronies.

yeh the precedence will be abolished for sure...when do they plan on having that bill for decriminalization passed anyways

when yeti means its legalized he means that there is no law plain and simple concerning marijuana

cultivation is legal

traficking is legal

THERE IS NO LAW.

will the POlice still bust you? yes they will

its unconsitutional but it will still happen till a new law is in effect but if someone asks right now if its legal the answer is yes. when the new law is intrduced then it will be decriminalized or recriminilized i guess.

Personaly I believe my short term memory has been affected but that is the main side effect and I also think maybe my short term memory has been affected.

this is not decriminalizing yet. currently there is no law against marajuana, and that case involving the 16 yr old set a precedent for other cases until a law is passed. yeti is correct.

petek read his post again. in ontario the law was replaced. but the law which replaced it only delt with medicinal use, not recreational. so there as of now there is no law in ontario. it's not 'legalized' in the sense that you can buy it at the grocery store and it's not decriminalized because there is no law against it, if it was decriminalized there would still be a law against it but you wouldn't be charged for simple posession.
