Here's the backstory.. my mom (and dad) own a womens fitness club located in my hometown Park City, Utah... It's been open for 4/5 years and well.. hasn't been doing Awesome.. i mean, we've made it, obviously, or we wouldn't be living in PC, but things could be better.. so it's been a stressful summer cause not to many people work out in clubs in the summer when you can go outside, so we were kinda on the edge.. with alot of money to pay, and not to much income, Disaster struck.. within one week our only computer's Harddrive crashed and the only back up was on the computer itself (i know, she's not the brightest with computers). so things start going to hell with everyones name, info, and creditcard info input on that computer.. not to mention billing and payroll.. so if you think that's bad, a fucking Idiot bitch of an old lady is now sueing us.. and the reason, she fell off the treadmill while trying to take her Fucking sweater off.. ya. basically if things don't end up right, we can say goodbye to a good life in a fun ski town and 300+ ladies can say goodbye to there rightful gym, along with 15+ employees.

so ya.. thinkin things through right now
 
america has such rediculous lawsuits! those things rarely happen in europe...

ya. but there calling our case a void because we didn't turn in a little sheet like 4 years ago stating that the tredmills had been moved. anything so they don't lose money, am i right?
 
how can she sue for hurting her self from her stupidity? doesnt she sign a liability waver when she joins? or something like that?
 
yes u are right but u should make a sign that said no multitasking on treadmills and stick it up and say that was up there so ur not responsable
 
i'm thinking about jumping on the treadmill at my gym tonight and trying to re-lace my shoes. if i get hurt, i'll sue! fuck the establishment, nothing's my own fault!
 
Like the lady who spilt how coffee on herself and sued McDonalds for it. Honestly, people are dumb as fuck. They'll do anything to get some money these days.
 
I thought that all gyms had a waiver that states if you get hurt being a dumbass, its your own goddamn fault. thats what i hate about people. nobody ever takes responsibility for their mistakes. ++vibes man, hope all this stuff works out for you

shouldn't she have signed a waiver when she signed up? Or did your parents not think to put one in because no one in their right mind should be that stupid to take off a sweater on a treadmill? Cause with an injury waiver, her case would be finished.

there's definately a waiver.. and in smaller incidents in the past, we'd always joke about how there should be a 'stupitidity clause'.. never thought it'd actually come into play

A) She won't win this case, trust me.

B) I am currently being sued with 2 aquantinces for $750,000 a piece. (I am not joking)

but this is a gym, they have waivers that you sign so the gym is not liable. mcdonals does involve heave equiptment and dangerous devices...

slight update as the day unfolds.. the hard drive is with someone in SLC as they work to recover everything.. no word yet. and we might, Just Might, have found a way to avoid any court.. maybe

as for the dumb bitch, counter-sue and say she broke your treadmill or something, or just sit here down and try to explain that your having financial troubles and a hard time, and that it would be morally wrong and fucking insane to sue you because of her own stupidity

but on another note, about you hard drive and all the info on it like credit cards, some one broke into my schools central office and stole a safe that had all of the staffs documents in it, like soscial security numbers and bank account information...
and both of my parents information was in it!

Your insurance company will assign the claim a case number and it will get handed to their corporate attorney. Hopefully he's smart.

Anyways....don't expect anything to happen for a couple of months, at least. Some cases like these will go to trial but thats even like 2 years down the road depending on the depositions with "witnesses" or whatever you want to call them. If your attorney is half way decent, the lawsuit should be dropped.

Btw, does the gym have cameras? (I kinda skimmed down so if it was already asked, my b)
 
Uh, I don't think you've been asked yet, but do you have a liability waiver that comes with the gym membership? Because regardless of whether the hard drive is busted, upon recieval of the pass for the majority of clubs, a waiver is automatically signed releasing the gym of all liability short of equipment malfunction. If she didn't have a pass, then it's trespassing, self endangerment and destruction of commercial property. If she did, then she's just a dumb bitch without a case.
 
my mom owns a health club as well, the only difference is that it is indoor with bball courts, weightroom, aerobic studios, tracks, and fitness rooms while outside there is a couple pools, bunch of tennis courts, a spray ground, minigolf, batting cages, etc.
 
15+ plus employees and you are just barely getting by? Time to fire some people methinks. The liability issue sucks but its not as though it wasnt preventable, your parents just didnt properly manage your insurance. Poor management, your parents should just get regular jobs since they cant cut it as leaders~
