Roommate problems HELP PLEASE +k

Ok so i leave for the weekend to go visit my parents, and i come home monday to a note on our kitchen counter from one of my two roommates telling me and the other to sign this piece of paper work:

ADDENDUM TO LEASE

Acceptance and Consent to Assignment of Lease

And Security Deposit Waiver

______Roommate_______, ("assignor"), herby assigns all right, title, and interest in and to the lease agreement dated __ 8/1/11 - 7/31/12__ for the premises located at __(our address)__ to _______(where he wants me and my roommate to sign)______ as of the 25th day of march, 2012. In consideration for the consent to this assignment by the Landlord, assignee guarantees the performance of all obligations of the lease agreement and assignor remains jointly and severally liable for all financial obligations of the lease agreement.

Assignor further acknowledges that they no longer have an interest in the security deposit for the premises described in said Lease, and that said deposit has been assigned to assignee as of this date. Therefore assignor acknowledges that he/she is not entitled to any or future refund or accounting of the security deposit.

Tear it up. Ask him what his deal is. Even if you've damaged stuff you can get it fixed rather than sign away your entire damage deposits.
 
No damages at all. He is trying to move in with some roommates that share some of his interests. I have no problem with him wanting to pursue different living arraignments. but shouldn't it be his responsibility to find a subletter to cover the rent and energy bills for the remaining months, or pay like he lives here?
 
It all depends on your landlord's rules when it comes to subletting (which should be stated in your contract with the landlord). However, if he does leave and move in somewhere else, he does not have to pay for the bills for the place you guys are living in now.
 
If you guys are in the middle of a lease your roommate can't just bail. He's obligated to make rent payments at the very least. Utility bills are only attached to the person who's name it's in If he does anyway, he will most definitely get a eviction on his record (this is assuming you guys signed separate leases with the landlord).
 
this. if he is on the lease he cant just bail out without any consequences. This just happened to one of my buddies. They have a 3br house. the 2 roomates fought with one of the roomates all the time. the one roomate decided fuck this and moved out. since he was on the lease he had to pay rent up until the lease was over for the apartment he moved out of. I hope this makes sense, tried to type it out quick and leave all the bullshit out.
 
Yes absolutely. This is your answer. He signed a contract, it's his responsibility to find someone to move into his spot or pay the rest of the bills until his lease is up.
 
yeah this guy is tied down definitely. not only is he responsible for rent he's also responsible for 100% of the energy bill regardless if you guys split it.

he may not even be able to sublet either. a lot of landlords don't allow sublets for obvious reasons.
 
More on the situation

here is the text conversation between me and the roommate: (word for word)

Roommate: rent is due friday

Me: yup i know

Roommate: Make sure to sign those papers

Roommate: are you guys not going to sign those papers?

Me: Not until we can find another roommate. Thats what i was legally advised to do

Roommate:But u guys arent even fucking looking for one

Roommate: Fuck it. I'll go find someone then if you guys dont by march 25th

Me: We aren't the ones leaving, we are looking but its not easy to do in the 2 days that we've known

Roommate: I told you a month ago dude!

Me: you said that you were THINKING about moving in with a friend from work, once again we are not the ones leaving. its not really the time people are looking for a new place to live.

Roommate: Ya ill find someone. By the way if i find someone its not gona be ok'd by you guys cause i new you guys would pull this shit on me

Roommate: Craigslist

Me: We arnt pulling any shit on you. you are the one leaving the lease agreement, sorry you feel that that is "pulling this shit on you.

Roommate: Thats fine i'll use Craigslist

 
yeah dude, for him to leave mid lease, he's the one leaving you guys high and dry, he needs to find another roommate or still continue to pay rent
 
That's too bad, my only advice would be to ask around and see if anyone that you know and could potentially live with would want to move in. The two of you might even want to take a look on craigslist because I doubt your soon to be ex-roommate will do much, if any, screening. If he is left to find a roommate himself it will probably just stick the first person that answers the ad. It might come down to that anyway but you could put yourself in a better situation if you look for a roommate yourselves.
