Red Bull will get hit with a wrongful death lawsuit on Monday after a Brooklyn man’s heart stopped shortly after he chugged a can of the energy drink.

Cory Terry, 33, died in 2011 after downing a Red Bull during a basketball game, and now his relatives are suing the company for $85 million, the New York Daily News reports.

The family’s lawyer, Ilya Novofastovsky, said Red Bull has “extra stimulants that make it different than a cup of coffee” and are “more dangerous than what Red Bull lets on.”

The lawsuit cites nine allegedly Red-Bull related fatalities worldwide, and the FDA has said that energy drinks have been linked to 18 deaths and 13,000 hospital visits, according to a 2009 study.

Red Bull declined to comment on the case, but a spokeswoman said that the company has sold 35 billion cans in 165 countries “because health authorities across the world have concluded that Red Bull Energy Drink is safe to consume.”

who in the hell drinks red bull in the middle of a game of basketball. while i don't play basketball, i can't imagine chugging a can of energy drink in between shifts during a hockey game. not exactly hydrating....
 
Hope you're right. They sink a ton of money into action sports. I'd hate to see that well dry up.
 
god pisses me off how nobody takes responsibility and just decides to sue all the time. american society/culture is kinda fucked in that way
 
If there is any negligence or prior knowledge of danger that can be proved in court they will settle for 5-15 mil.

People are so fucking retarded. I have a heart condition, I don't drink Redbull. How hard is it? You can't die just from caffeine (within reasonable amounts, of course), unless something is wrong in the first place.
 
That well wont dry up. Its one of Red Bulls biggest markets. Regardless, this will not make it to court theres to many external factors that come into play
 
family has very little chance of winning. It's not redbull's fault that kid didn't understand that it's not a good idea to elevate your heart rate before/during intense exercise
 
when I read it I just assumed he was watching a basketball game.I drink energy drinks all the time (I know they're garbage) but the last thing i'd do is be poundin dranks in the middle of intense activity. and what is the 85 million for? they think cause their dipshit relative made a bad choice and died from it they deserve 85 million dollars in compensation?
 
I definitely wouldn't be surprised if it did make it to court. I don't know all of the evidence but if they play their case right they could definitely have a chance. Much stupider cases have won in the past.

Mastercraft boats get sued for 31 million a few years back when the nose of the boat sunk under when they hit their own wave when they had one more person over the limit and 12 of those people were sitting in the front and the driver was drinking. Mastercraft lost.

The claim on this lawsuit is not that the caffeine killed the guy, but that there are other stimulants in Red Bull and other energy drinks. The problem is that this law suit might compel the FDA to take a closer look into the ingredients in Red Bull, Monster, etc. If the FDA identifies and decides to target a specific ingredient such a Saccharin during the 70's, then the sue happy sharks will be lining up to take a bite out of Red Bull.

I have no idea how this will play out, but if the FDA gets involved, all bets are off.
 
red bull will pay them off less than half what they are suing for, and we will never hear of this again. just like all the other cases exactly like this one against red bull.
 
How the FUCK is this a lawsuit? It wasn't the fucking Red Bull that killed him unless it was laced with rat poison. That's like suing Starbucks because you got hit by a bus after drinking a latte. Shit happens. Fuck this family.
 
Monster has been sued for a few deaths over the last few years. In one of the cases, I think I remember reading that the person would have to drink 80-something monsters at the same time to be lethal. Obviously that's impossible. I don't expect anything to come out of this just like nothing has happened to monster in their suits. Red Bull probably has been sued like this before as well.

Ive never undersetood why they sue so much, but also the ridiculous amounts they demand too.$85 his family wants because their son/dad/husband did something stupid? I understand that his family will probably have a tough time financially after his death, but Jesus fucking christ, 85 million?

How much do you know about that case? In my opinion it was pretty substantiated given the negligence by McDonalds. Its sort of sad that the media used that case as the poster child for frivolous litigation. This redbull case is bullshit though, I don't know enough about their ingredients but I can't imagine the drink had anything to do with his death, some people just need a scapegoat for an unfortunate circumstance.
 
Yea she actually got really fucked up in the accident. As dumb as it is for her to sue for something that obvious, she did deserve something other than a free happy meal cause she got a messed up downstairs now.

McD's, there is actually a video explaining the reason for the sue and all of that. The media really manipulated the story. The video says what really happened and I actually understand why she did it. Not exactly agreeing with it but I see why she did it.

Anybody who tries to sue for that kind of money in these cases should be laughed out of court.

Then again you can sue for anything these days. Red bull isn't good for you, fucking riveting. The giant bacon burger somebody chokes on and kills them isn't either.

I agree not gonna make it to court. And seeing red bull brings in 4 bill in sales a year wont really hurt them.
 
How did you miss that 180+ causes third degree in 2 to 12 seconds, she also wasnt asking for much money, she thought that McDonalds owed her medical expenses and that was it, if McDonalds wasn't negligent in heating the coffee to 180 or so degrees then I highly doubt she would have won the case. Even McDonalds acknowledge that they were putting customers at risk by serving them coffee higher than 150 degrees in poorly designed cups.

The judge rightly assigned blame on both parties and reduced the damage to McDonalds. If McDonalds had published the temperature or warned about its extreme heat then the lawsuit would have been null but they failed to inform the consumer resulting in a lawsuit. They could have also avoided a lawsuit if they just paid the stupid customers medical bills...

That's right: more than $65 million for one pair of pants. Representing himself, Judge Pearson cried in court over the loss of his pants, whining that there certainly isn't a more compelling case in the District archives. But the Superior Court judge wasn't moved: he called the case "vexatious litigation", scolded Judge Pearson for his "bad faith", and awarded damages to the dry cleaners. But Pearson didn't take no for an answer: he's appealing the decision. And he has plenty of time on his hands, since he was dismissed from his job. Last we heard, Pearson's appeal is still pending.

 
She was 79 when it happened. There was not a whole lot going on in and around her downstairs at that point.
 
That website is going to raise my blood pressure. When I die from complications from that, I'll have my family sue them for the sum of the day and month multiplied by $1,000,000 for their neglect.
 
This, then again RedBull is terrible for you, but it's simple. You don't drink it, I'm pretty sure redbull cans even have warnings on them
 
Sure she gets burned, but McDonalds must inform customers that what they are purchasing has the ability to do grave bodily harm, they were also using substandard cups not designed for coffee at that tempereature, both of which could have (but probably wouldn't) prevented the accident. I don't even necessarily agree with the laws that were used to get McDonalds to pay, but it seems pretty agreed upon in the business law world that the case, not necessarily the payout was justified. McDonald could have helped her out with the medical bills and avoided the millions that they had to pay.
