NS, is this legal?

So, another NS member and I were at a school dance last night. Our school hires some private company ( http://www.k9resources.com/ ) to snoop around for drugs and alcohol at school events and during school hours. We saw them there, so we thought NBD we didn't do anything so we should be fine right? wrong. They called us out of the bathroom to do a random alcohol screening? They said that if we didn't comply we would be kicked out of the dance and suspended. So we did. it wasn't a breathalyzer, it was one of those strips that you lick. IT required us to sit for 15 minutes with k9 resources and our principal so our mouth gets all dry, and then lick the strip in front of everyone. It came out 0.0%, but I still feel like we were treated unfairly, as far as I know no other people were screened. (It is a private school if that makes a difference, they do what they want.)

Its fucked up, but schools can do just about anything they please. They practically have their own jurisdiction.
 
Unless cops have reasonable cause they can't actually make you take the breathalizer. If they make you take it you can charge them for it if there was no real reason for it, and can get a settlement from the state. That is why you take the sobriety test before you get a breathalizer
 
wrong. in a school, they only have to have reasonable suspicion which is basically a way for them to do almost anything they want. its fucking high school anyways so who cares.

it seems like the "probable cause" shit went out the window years ago. cops around here in seattle are fuckin killing and harassing people for no reason all the time these days.
 
I think it is different when you are on school grounds, they have an entire new set of laws that pretty much makes it so you have almost no rights. For example, a school can search your locker at any time without notification, I don't know if they can go through your backpack or not. I wonder thought, if you refused and they had no probable cause I only think they could have kicked you out, but not suspended you, who knows.

Its a private school, so if they choose to hire a company and select you guys for a test, than they can do it. get over it
 
private schools really do whatever the fuck they want. Im a senior in a private highschool and i got arrested last year so now they can drug test me whenever i want and they put me on disciplinary probation. I've never heard of schools hiring their own security team from a company before

Yo sorry i know at schools they can do it. I was talking about driving, you will never take a breathalizer before a sobriety test or at least before you give reasonable evidnce that you are intoxicated.
 
sorry for the confusion i was only talking about driving. On school grounds they can do whatever they want really.
 
If you ever feel uncomfortable at school or if your having a teacher treat you like shit even though you might be wrong, you can always play the lawyer card (you must have parental back-up because because it really needs to be a convincing bluff.) Schools don't fuck with lawsuits
 
Because private schools have no obligation to keep you, they can do random tests if there is probable cause. Also, if you are on any sort if probation with the school, they can test you at any time. I know all this from experience. It sucks
 
To the best of my knowledge, cops can breathalyze you, or search your bags without a probable cause, if you allow them to.

If a cop ever comes up to you and poses it as a question ("Can I see what's in your bag there?" "Can I take a quick look inside your bag?"), tell them you don't give them consent to any search or anything. That has saved me countless times haha.
 
Dude, same here with our dances kind of, they have breathalyzers on the way in and out but you can still blaze up before.
 
I would have acted drunk as fuck, passed out for the 15 min and then to strip would come out to 0.0%. Their minds would be full of fuck.
 
new jersey vs t.l.o. => you pretty much have no rights in school. specifically the fourth amendment doesnt apply in school.

ya i gotchaso i was at a party this year, some girl gets real fucking sick, kids do the responsible thing and get her an ambulance soon after, about 10 cops show up, close off all exits, and sit everyone downstart getting the names and addresses of everyone at the party and then have everyone take a breathalizer test. why? because if they didnt do that, and let everyone go, and someone were to get in a car crash on the way home, the cops would have been responsible
just a situation where as fucked up as it seems, everything was 100% legal and even mandatory by law
 
i go to a boarding school, so youd think that the school would only have jurisdiction over students when they are on campus, right? wrong. in the handbook it says that "the deans may extend there jurisdiction where ever they feel is necessary" so they can do anything they want to students and get away with it.
the most bullshit thing ever was when my friend, who hates the school and the school hates him, got called in for a random drug test... IN THE MIDDLE OF THE SUMMER. he was told this in an email and he lives 1000 miles from the school, so he just replied to the email, "no." they kicked him out.
i left eh school too becasue i didnt like it in the first place and this put me over the top. GRRRR ITS SO STUPID!!!!

Before you went to school in the fall, you probably had to sign some papers. In those papers you gave away nearly all your individual rights. In those papers you probably consented to that type of testing. Schools can do pretty much whatever they want.
