Need legal advice

Today I was arrested for possession of 6 grams of marijuanna. But first I'll explain the story. So me and my friend were at a spot and he was smoking in a shack and I was outside the shack when the cops showed up. So they strait up went in and my friend completely admits to it so they check him and find weed (he consented to a search). Next they ask if they can check me I say I do not consent to any searches then to which they said we have the right to search you if we arrest you. so they arrested me for possession of marijuanna before even seeing any form of marijuanna in which after they forcibly search me finding 6 grams or marijuanna. So any ns who are experienced with Canadian (Ontario area if that helps) can you please give me some legal advice. What should I do was that illegal search and seizure?
 
Yeah, considering your friend had weed and you were with him, that seems like it gives them probable cause.
 
Even if he admitted to it I made sure I was firm on the fact that I did not consent incase it would do some good in court.
 
its good that you made it clear you didnt give consent... but still you are affiliated with another whom is breaking the law, you are probably subject to search also.
 
It did look like I was waiting outside for him to finish smoking and this is why I am asking ns for advice because I do not completely understand probable cause.
 
yeah the second your friend admitted it he basically fucked you over, but it was pretty dumb of you considering they can use that to say you were resisting or obstructing. if they really want to

1. got a speeding ticket,

trooper told me to roll every window down then said they believe marijuana was in my car.

he handcuffs me to a road sign, searches car finds nothing.......... then starts ripping up carpet, components, interior plastics

he stripped my car apart on the thru-way.. half hour later he found 2 vacum sealed packages well hidden in a secondary fusebox only accessed by removing dashboard.

cops just need a hunch that you are doing something wrong

your word against theirs

you can be sober at an underage drinking party, breathalized and still

get arrested

look on youtube for consenting to searches. cops often attempt to abuse their power. the power of recorded video footage seems to stop this abuse of power and increase the power of the induvidual.

 
I wish I understood law better. I always see the stories of cops abusing power and it just pisses me off! Then I remember I have no idea about how law works...

this was the only time ive actually been shafted by the law

$3500 down the drain on legal fees = no record of CPM, CPCS, criminal poss instrument

redemption= trooper spilled bong water on his pants

punch in the nuts= they used my scale to weight the packages

 
If the cop says he smells weed, he can search your car. Doesn't matter if you give consent or not.
 
Yeah theres not much you can do.. Your second mistake is coming to NS for legal advice. If you want legit answers, spend the 500$ for an initial consultation with a lawyer and figure out your moves. Im pretty sure just having 6 grams would more or less be a fine and a slap on the wrist more or less.

Ive had some friends get busted with around the same amount as you and the cops didnt even waste their time, just dumped it out and gave them a warning. (I live in Ottawa, so in your "area") Its such a gamble with police but normally, Ive found from personal experience, that if you are straight up honest and let them do their job they normally cut you some slack.

So go call up a lawyer just to have a quick chat if anything, to find out all your options. Because NS is NOT the place, unless you want people making fun of you and giving you random legal jargon.

theres been plenty of times ive successfully tried to be a legal eagle and didnt get searched/ trouble

Ya until Parents came and prevented cops abusing power

-why are you holding my (adult) son

-original crime he commited inorder to be stopped

-how did you enter this residence

for cops to follow true protocol they need to see adults around, be in public, be on video

otherwise they pull over every teen driver for bs reasons, SUGGEST cars smell like marijuana.

Cops feed off kids incriminating themselves.

technically you can walk down the street and show off your gun ( not like aiming it / pretending )

but a cop is gonna TRY to tell you, that people have called in reports of a gun weilding suspect

in reality if they cant immediatly call you out on commiting a crime, they have no right to talk to you

all things considered i wouldnt say its the worst. im not saying you should try to represent himself based off what a website told him or anything, but he can still benefit.

lawyers cost money, posting is free and immediate. he can get opinions and information from a diverse group of people, a certain portion of which have gone through very similar experiences. you're a lawyer for christ sake! although far from the best, newschoolers is not the worst place in the world to start.
 
true but i'm pretty sure unless the cop that pulls you over has a k9 with them they can't detain you while waiting for the k9 unit to show up. can anyone verify this? i've tried researching but i'm finding mixed answers
 
They can detain you for a little while but not too long - yes that is pretty much it, and guess who decides weather or not it's too long? the judge.
 
nope that is 100% fucking bullshit stop spewing nonsense out of your uneducated mouth, I sat down and talked this over with a lawyer when i got fucked in a similar way. Probable cause reigns
