PrintA New Hampshire family who witnessed a SeaWorld Orlando trainer being drowned by a killer whale is suing the park.

Suzanne and Todd Connell of Somersworth, N.H. say their 10-year-old son was traumatized after witnessing the deadly attack.

Trainer Dawn Brancheau was dragged underwater by her hair by the 12,000-pound whale, known as Tilikum, before a live audience in February.

The suit comes just days after federal authorities fined the theme park $75,000 for work safety violations stemming from the incident.

The family is seeking more than $15,000 in damages, with the Connell's saying their son suffered from emotional distress.

The suit describes the scene as workers tried to rescue Brancheau from the grip of the whale's mouth.

"There seemed to be no plan as to what to do to save Dawn," the lawsuit says. "The SeaWorld employees were acting in an unorganized and chaotic manner."

SeaWorld Orlando declined comment.

At the same time some fuck is suing a Korean game company for making him addicted to Lineage II. Many cases like these show that the US justice system is completely beyond redemption for now.
 
Seaworld profits from people viewing their animals, they are responsible for the spectacle.

Caged animals are actually pretty disgusting, it's fucked up you ignore that entire aspect of the situation, but even the validity of the suit was above your grasp so I guess it's par for your brain.
 
they won't win. that whale, Tilikum, has killed three people now, one of em was some stoner who broke into the tank at midnight and tried to swim with it, he got a Darwin award, funny shit. there's a reason they're called killer whales..
 
i saw a dude die in a plane crash at an air show. i didnt sue the air show people. ppl dying is a part of life get used to it
 
yeah but everyone experiences 'emotional distress' in all shapes and forms. its a part of life and character building. good parenting can help a 10 year old child cope through a situation like this...it is after all part of being parent. sure this is a little more tragic, it just means it requires more attention. suing is giving this kid the wrong impression on how to deal with situations like this.
 
I've been to multiple fatal car accidents. One where a guy was nearly decapitated after hitting his head on a light pole while on the back of a motorcycle.

I've done CPR on 20+ people, not all survived.

I've been the person who found a woman unresponsive and not breathing in a fire, and she died less than 1/2 hour later.

I've been to a house explosion, where a woman came running out of the building on fire, and died a day later.

I've been to a hanging and a gunshot suicides.

Anyone know a good lawyer??? I guess I can get rich out of this!!

If proof is made that the trauma actually affects the kid's quality of life, this is a legitimate lawsuit. Seaworld is responsible for the security of its customers : if someone trips on a poorly maintained feature of the park and gets hurt, they have a legitimate right to sue. Same thing for psychological trauma.

The system might be fucked up sometimes but this is not one of those times

Yeah, but that's a bullshit reason to sue somebody. Parents are just money hunting. They should get fed to shamu. These bullshit loss suits have gone on for way to long. Tripping in a pothole and getting 85k for a rolled ankle(happened in my town) shit like that.

These judges should be beat repeatedly till they stop being douche bags.

You're serious? That's...unbelievable. Soon people will begin to sue if the bus/metro/train is late or if the red light was on for too long and they came to work five minutes late and shit like that.

Stereotypical stuff aside, I hope that US citizens' predictability and the judges' conformity doesn't spread around to other countries too much. For example, there was a case in Finland recently:

A woman was working in a food factory. She hit her head by herslef to a part of the machine she operated and she lost her ability to work in latter months (never explained to public how exactly). She won 75,000 euros in the court for mistreatment of safety instructions as she was not told that, yeah, working in factory you gotta WATCH WHERE YOU PUT YOUR FUCKING HEAD. The company appealed and supreme court decided, truthfully, that fuck you bitch, you ain't getting a dime.

SeaWorld has a responsibility to protect it's customers. If a tiger gets out of it's cage, and eats a couple tourists, then yes, SeaWorld has failed to protect people, was negligent, and should be sued. But this is a case of a freak accident, perhaps even an act of god. It's bad enough that one of their employees lost her life, but now this family is trying to suck extra money out of the place.

To others, yes, I am a firefighter.

And yes, I've been to a couple hangings.
 
First off, I am in no way saying that caging animals is a valid thing. I don't go to theme parks like that because I don't like seeing them in captivity like that (not to say I don't enjoy roller coasters and rides).

Seaworld profits from people viewing the animals because people WANT to see them. They're there to see the 'wild and natural beauty' of a powerful, deadly predator. It's comparable to somebody suing whoever runs the X-Games because an athlete got hurt and 'scarred' their child. They want to be there, and should realize that animals are wild, and it is impossible to accurately predict what they do.
 
I'm betting that without zoos/profit from caged animals a lot of species would be endangered/extinct right now. Just sayin...

Like I said before, if it is proven that the trauma is real, the parents have every right to sue Sea World. There is a concept in the law called ''responsibility of the employer'' that states that the employer has to take responsibility for damages caused to others by its employees and it seems that the alleged trauma has been caused by the killed employee. I also read that that was apparently the third person killed by that whale, this is not gonna play in favor of Sea World in court as they will be easily discredited on their security measure quality.

And of course it is possible that the family's trying to fraud Sea World, in which case I hope they loose.

I pay money to drive on toll roads. If somebody gets into a nasty car accident and there is blood all over, can I sue for trauma?

If I'm skiing at a mountain and I see somebody hit a tree, can I sue for trauma.

If I ignore the signs at the zoo and climb into the tiger cage and get my arm bitten off, can I sue?

The answer to all of those is probably yes. People sue for the most ridiculous shit these days and far too often win. Even the legitimate cases where they could sue, They are getting 100k instead of 10k, or 4.5 mil instead of 50k. The amount you can sue for is just outrageous. Judges need to get beat repeatedly until they grow some balls and stop putting up with this bullshit. this is why insurance rates are insanely high, you can't do anything fun anywhere anymore, and everyone has to be worried about getting sued.

Fuck this shit man.
 
But in the end in US, is it about the judges? Isn't it the jury that makes decisions? Judges just have to abide by that decision? Enlighten me.
 
Well you can certainly try but chances are you won't even make it to the court room because you need a valuable reason to sue.

All i'm saying is that this whole case will be determined by whether or not the trauma is real and the nature of the damages caused, the kid obviously doesn't work so i don't know how they would calculate the compensation ammount but you see what I mean.

yes, this is fucking retarded. people trying to take advantage of the system makes me lose all sympathy for them. whats the bet the kid isnt even that distressed. and how the fuck can you put a price on the severity of his trauma? where did $15k come from? if they are entitled to anything after this, it should be free counselling sessions, or something along those lines, until the kid is 'better'.

I believe he was traumatized. People have seen worse things though. Parents should have put on some parenting skills and covered his eyes or brought him out of there. Bad shit happens. Seaworld just lost one of their fucking employees in a tragic accident and now some family is suing because everyone sues these days.

They will probably end up getting a million bucks that they don't deserve. People just sue for eveything these days. At least in the old days people just sucked it up, grew a pair, and lived on.

its called being a responsible parent and covering your kids eyes and removing them from the area when bad shit is happening. they probably let the kid watch the whole thing and never once though about what could happen in the future to the kids mental situation. you don't have to tell the kid that the person was killed. the kids only 10 for fuck sakes. shitty parenting.
