Legal assistance/opinions required (canada)

so my bro is getting charged with assault and I was wondering if anyone had any advice or experience.

here is the story: an uninvited guest at our party was being an ass, so he had to be kicked out. He was hostile inside so he had to be dragged out. When he was outside he ran to our neighbours house (it was around midnight) and rang the doorbell several times and tried to push his way in when my neighbour opened the door. My brother then grabbed him and threw some bombs (after he swung and hit my bro), my bro knocked him to the ground, where he was bootfucked by a few (bitch-ass) kids. The kid was out cold so my brother called an 911 asking for an ambulance. soon enough, 2 ambulances and 5 cop cars arrived. when they asked my brother what happened, he admitted to beating him up, so they threw him in cuffs and took him to the station. he was released the next day.

the official charge is Assault Cause Bodily Harm, my bro is 19, and this is his first offense. the kids face is very messed up tho, he needed 10 stitches and his eye was swollen shut.

some background info on the kid that got pwned: he's already been convicted for when he kicked down a random door in a drunken rage and assaulted a random homeowner at night once, and has a history of violent, erratic behaviour.

well NS, your thoughts? what are the chances of this getting dropped? what is the most likely outcome of the case?

If you're going to hate, I'll just get the thread removed so try and be helpful.
 
what are the chances of it getting dropped? fairly small. what are the chances of him getting convicted of anything? also very small. Any halfway decent attorney should be able to get this case taken care of. (I'm American, but I can't imagine the Canadian system is all that different when it comes to the legalities of an assault case.)
 
Well, if the kid has a record maybe your brother was defending himself? Or protecting your nieghbour from him assualting them.
If it is his first offence most likely the charges will get dropped. Assuming your story is true, your brother might be given a dont do it again but thats about it.
pled the 7th if all else fails!
 
yah we're already looking into finding a lawyer who is a local where the courthouse is (milton, ON.... if anyone knows any good lawyers there let me kno! lol).

he's also already signed up for substance abuse (he was drunk), and anger management, and is working on getting character references from anyone and everyone (including the neighbours).

I figure he will get a suspended sentence (which means the charge will pend for 2 years, and assuming he doesn't get arrested for anything else, it will be dropped and the slate will be clean)
 
i got charged with gang assault for a similar scenario, your brothers first mistake was admitting he beat up the kid. Get a lawyer and the charge will likely be dropped or extremely reduced after the lawyer explains the circumstances of what happened and this kids violent history. I got my charge reduced to harassment, and will never fight again, it's not worth it. Tell your brother to keep his head up and stay out of trouble and let his lawyer do the work. Gonna cost some money, but it's worth it.
