An interesting and valid discussion has recently been active on NS pertaining to terrain parks and law suits. These discussions involved a speicific court case that is currently under way in Vancouver.

Because the court case is currently active, and some content in the discussion has suggested intimidation of the plaintiff, it has been suggested to us by lawyers that the specific details be removed from the discussion.

We have been involved in many lengthy group talks about the incident, and we feel that trying to intimidate or persuade the jury could in fact have a negative outcome, from what we have been told by lawyers.

We totally encourage you to proceed in discussing law suits in respect to terrain parks in general because we feel that it is a valid concern, but there is no need to discuss the details of the case directly.

i dont think anyone involved in the case or thier lawyers came on this site and found that particular thread. Im thinking NS was the one seeking the advice of it own lawyers. I could be wrong though, so dont hold me to that!

i really don't understand the legal basis for suing the mountain. they made a jump, which is essentially a large mound of snow. you could ski slowly over it (if you wanted to have a shitload of people pissed at you), you could avoid the trail it's on, or you can go fast at it to get up in the air.

how is it the mountain's fault for any injuries you obtain doing that? if any court would ever rule against the mountain, it'd be like saying you can't have skate parks, diving boards, gymnastics, all sorts of shit. mountain climbing? out of the question. there's sooo many activities people do where you can get hurt if you don't know what you're doing.

i mean, what are this kid's grounds. the mountain is negligient for designing the jump poorly? or having it there. if for having it there, i guess they can't have any back country with cliffs in it, because you could kill yourself there. in fact, no ski trail is safe, because if you don't know how to ski, you could ski in to a tree and die.

to conclude, anyone that brings a suit like this, and any judge that would listen to it, is hurting the gene pool.

Do you really all think our sport will go extinct...hell no...we already do urban rails that are illegal, we will build parks back up, and up, and up, until something happens...this greedy bitch wont win, but if he does, the sport will go on...there are probably over 50,000 of us, and we are rich enough to afford Jonny Cochron (the guy who defended OJ)...this is bad, i am not saying it isnt but it wont be the end...

look at it this way...most of the jubbing community is on this website, including some of the most influential ones. Lawyers are smarter than we think and if they have a chance to sway the jury or even try and get a new case together, they're gonna do it because

1) it puts more cash in their pockets

2) it might better than chances at a victory

3) this site might also provide some valid info on some upcoming cases because people are talking about their injuries in terrain parks, illegal inverts and things like that..

lawyers are cock shit and a good lawyer stops at nothing in order to win his case or make some $$$

I think what k2skier was trying to say was

A)Lawers could use posts that say 'I want to kill that greedy punkass bith' to create sympathy for his client(look how brave he is to stand up to this critisisms to do what he believes in)

B)Use the many posts in our forums about our war wounds from the terrain park as evidence that terrain parks are dangerous places because so many people hurt themselves in them.

they are not gonna shut down any terrain parks. alot of bigger mountains pride themselves on having the best tables, rails, jib etc. and abunch of smaller hills are now realizing that terrain parks are such a huge source of revenue that they are almost becoming dependent on them. terrain parks are to widely used and will always be there. they are not gonna be shut down. most hills will likely adopt the policy of helmets maditory and having to sign a waiver when you buy you hill ticket or seasons pass. but who gives a shit about that, when that happens the parks will just become better. hills will be able to put up the stuff they were worried about getting sued over because you signed the waiver. their are alot of loopholes to the waiver on the back of a seasons pass. did you know if the ski hill leaves an unmarked obstacle like a snow hose lying on the hill and you crash into it, you can sue. but terrain parks are marked. and with the more in depth paper work we sign the more shit they can put up in the park. this fuckin post is propaganda, terrains parks are not going anywhere.
