Im looking for something thats $30-$40 and is not junk. The last headphones that I got were about $80 they stopped working after a year due to crappy wires and the company wouldn't respond to my warrantee claim so they are bastards, that means im looking for something other than Sennhieser.

No personal experience with the in ear ones but i have a pair of their LP2 headphones ($100 on amazon if you'd like) and they sound better than sennheiser and blow beats out of the water. A bit over your budget, but they are well worth it and are bulletproof. I beat the shit out of mine, stepped on several times, fell out of car and a bus and went through the airport at the bottom of my bag with nothing but a few cosmetic scratches. Hope this helped.

This.

All the cables have eventually worn out on my klipsch earphones though. I don't really think thats avoidable. Klipsch warrantees their headphones for 2 years for manufacturer defects though, which includes cables failing. I bought a pair 3 years ago from future shop and I'm on my fifth pair of headphones now, all which were covered under warranty since purchasing the original pair. That first pair was a fantastic investment, I've received over $400 in headphones on my original $100 investment. Hit up a best buy near you and ask them about the warranty on the klipsch headphones, they might be a bit above your price range but the money you'll save in the long run makes them well worth it.

warning shameless product plug;

We make bluetooth in-ear headphones called the Tags that retail for $64.96 a bit more than you were looking for but less than the last ones that fell apart and our customs service is kick-ass.

Feel free to check them out and PM with any questions or I'd be happy to answer them here in the thread.

steal one of your friends samsung earbuds from their phones. I stole my moms, dads and sisters and they work remarkably well, and sound not bad for some low quality headphones.

I have skullcandy titans, they're pretty good-I'd give them 8/10. Those are about $40.

What you need to do is get warranty on your headphones. At Best Buy it was like $8 for mine, I think it covers a year. I don"t take the best care of my headphones, one of the speakers always seems to start failing after 5 months for or so. So I go back to Best Buy, show em the receipt and get a new pair. The guy charged me $2 the last time. So I'd recommend getting a nice pair with the warranty.
