How to talk to my landlord

So here's some text messages that I got today while talking to one of my old roommates after I left my apartment and went back to New York I am the only person left on the lease so If it is not paid I have to pay it out of my own pocket. Sorry for the miss spelling i was pissed while typing.

So how would I go about telling my landlord about the situation because they're in Colorado and I'm in New York and I don't have any money I paid my share and left. Also my lease end this month and there's start next month.
 
ya your friends an ass, no amount of cleaning labour is worth an extra $400. god knows hotels pay by the penny for that kinda work.
 
Its a lot more then that because the other kid didn't pay either and now were being charge a late fee so it's going to be 800 to 1000 but what is the est way to work this out and exsplane it my land lord.
 
Im not living there anymore I paid my share and left for ny this is in breckenridge co I'm just trying to figure out if I get my security deposit back because I have $580 I would like to get back but being that my roommate didn't pay rent I'm probably never to see that money. Just want some tips on how to be professional about this over the phone explaining the situation.
 
Fuck all I know is the font on NS looks very fucking small now thanks to you. Good luck though man, my sister just went through this bullshit. Luckily for her she had a chill landlord and only had to pay for her half.
 
As someone who has been screwed before. GET EVERYTHING SIGNED AND IN WRITING that way you have recourse for shit like this.

 
if youre the only one on the lease youre the only one responsible for paying. He will keep your deposit, he might sue for the amount of rent up until the next tenant moved in (he would win) and have your wages garnished, it's a huge hassle. You can in turn sue your friends in small claims court, a judge would probably side with you in that situation.

I'm a landlord, and would probably sue you in small claims court for what I'm owed. I can't pass the loss along the chain (except as a business loss on taxes). My signature is on the bank loan, and HOA's will put a lien on your property if you don't pay. And attempting to get payment from someone who was never on the lease is near impossible.

It's a shitty situation, you need to talk to your friends or their parents if they are young. Or you can just wave good bye to the security deposit and hope he has better things to do with his time than going after the remainder.
 
This happens way too much, I never put my name on the lease unless ALL the people living there do too. But everything Static said is what I wanted to say, mobile quote allowing
 
Contact your landlord an outline the situation plainly. Ie when you left, payments etc. tell him you were done with this place and moving On and were contacted in ny. If this kid I still planning on living there you have him by the balls because you could just tell the landlord it's on him and hell have to do something if he wants to continue living there. Regardless of lease signing, it sounds like you were at the end of yours and frankly as a landlord, I wouldn't go through the hassle of bringing you to court from across the country unless you destroyed my place and I had no contact with anyone currently there. Jut be courteous and if need be get parents involved (sounds like you may not have been on your own too long). Good luck bud, If I have roommates we all sign the lease or someone else can. No fucking way I'd put my name on one of those again with roommates haha.
 
ya man, I'm sorry but you're SOL. Your friend is a prick, but you are the only one legally liable.
 
I've never come across one. Last place I was in charged me 250 dollars for losing my key.
 
Yeah there's no lack Of shitbags in the trade either that sucks. My parents and I are land lords and they work with people but you never know.
 
not very often. land lords get fucked over much more than tenants do. Plus for most cases (this isn't one of them), is they take it to court it's much harder for a land lord to win their case.
 
wait so you have enough money to move across the country? ( and presumably fuck around all winter) but don't have a few hundred dollars to cover your living expenses when shit comes up?

Odds are pretty good he'll just keep whatever he's owed out of your damage deposit, which is usually like a grand anyway. If it's short by a couple hundo he may not think it's worth bothering about. You could pay and sue these guys in small claims but that'd be a PITA.

Yeah I mean at this point I'm just trying to get the 400 my payment for this months rent back I'm just hoping my landlord can keep security deposit because she needs to understand that this stupid girl shouldn't be living with them next year.
 
Chances are if you just don't pay he is not going to take you to court over 1 month's rent. It just isn't worth it for him.

it's not? close to $1,000 for a case that will easily go in his favor. It's not like he needs to do any prepping, all he needs to do is provide the judge with a piece of paper, which he has. I'd argue it's not worth zzskis time to take it to court because there's no way he'll win it, unless the living conditions weren't as stated in the lease
 
Idk i've known three people who walked out on their leases and the landlord didn't go after them, two of them were for 3+ months rent. I've also had landlords tell me that it's not worth the hassle of going to court, paying court/lawyer fees. Especially because for most landlords it's just a side job for a little bit of extra cash and not how they make their living.
 
well no i paid this girl and guy my last months rent and she didn't even give it to the land lord, but if they keep my security it'll come down to about 200$ if even that but im in ny and im not going to co good luck trying to get me into a court room. and i feel bad im not trying to screw over the land lord but shes need to talk to the people living there and tell them give me the money or gtfo.
 
good luck trying to get you in a court room? ha. dont show, and a default judgement is awarded. Then they can garnish your wages. Your landlord isnt gonna do shit about getting your money back to you from the girl.

Save those texts, thats the only evidence you have in trying to get your money back from the girl.
 
There is your problem, you shoulda paid the landlord directly. You can never trust anyone when it comes to money.
 
is your landlord a good chill guy? I would say explain everything. you have pictures of your friend saying that shit its just as good as documented proof... and he may be able to charge your firend for it and he would be out on his ass..
 
and btw, Usually there is a line in the contract that states the penalty for breaking the lease (ie. not paying the last months) is a forfeiture of the security deposit in addition to rent owed. The security deposit is just what they get without taking it to court, and wouldn't count at all towards and rent owed.
 
also, if they are still living there and the landlord chooses to evict, it will only show on your record. Good luck finding a place to live with that cloud over your head.
 
Well, in a lot of cases the landlord is able to re-rent the property fairly quickly. Between keeping the damage deposit and a quick turnaround to getting a new person in there, they actually don't lose any money. If you ditch your place on Tuesday and they get in another renter Wednesday paying the same rent, they CAN'T sue you no matter what your contract says because they weren't damaged by your breach of it.
 
Make sure you don't have pants on when you go to talk to him/her. It'll show them you're for cereal
 
Girls fb? Ns message storm telling her it was her job to clean anyway? Lol regardless probably kiss your security deposit goodbye but I doubt he'd bring you to court. Not worth the headache and hell get his money anyway. As for it not going towards rent like someone said, I don't think that's right because if the place is suitable to live in deposit should come back with rent taken out. Not security deposit plus he could sue you for back rent that's not right I don't think.
 
Were the other people on the original lease? Or was it just you on the lease? Did you sublet to them? This situation is kind of unclear how you have presented it.

You shouldn't have just bounced out of there with out getting your name off the lease. If you're the only name on the lease - just because you paid for when you were living there doesn't mean you can just leave. Since your name is on the lease you're responsible for paying for the term you signed for...

Before you moved out you should've talked with your landlord to get the lease assigned to the people who were still living there or you should have subleased to the people living there.

Also why did you give the $ to some random chick / guy to give to your landlord... You should've paid the landlord directly...

It seems like you made some dumb moves and got yourself into a really shitty situation.

Bad roommate situations blow... I had one last year because my friend's psycho girlfriend. I ended up talking with my roommate & landlord to get things worked out, my roommate agreed to take on my portion of the lease so I could move out.

I assigned my portion of the lease to my friend, so he took on two leases (expensive!), talked with my landlord to make sure my name was off the lease and that I was free to go. Then I moved away, and got my security deposit back.
 
not really there are 2 people living with me. one since September who came with me to sighed the lease, but according to this new girl who has now taken over this property says there is no record of him doing that, but i saw him sign it one year ago. also this bitch has been living there the last 4 months we had no problems i always worked when this place that runs the property summit mountain rentals is open. so ive always gave her the money and had no problems i really never thought she would just take it. so i guess yeah it was stupid but i never would have expected that a person could have been such a low life and a peace of shit.
