How is youtube legal?

Now I've done absolutely zero research on this so I'm sure the anwser is quite obvious.

Is youtube legal?

I'm not talking about the videos that the users actually make and post. If you want to post your stupid home videos on the internet, be my freaking guest.

What I am talking about is all the music videos that have been posted. It seems that I can listen to almost any song I want to on youtube. It seems an awful lot like file sharing to me. So why is youtube legal, yet napster got shut down?
 
i think youtube isnt illegal because they made it so you cant download anything you watch on it (unless you download an illegal program to pull things off youtube). Napster was shut down because it let people download anything they wanted to their hard drives, breaking copyright laws.
 
technically it is illegal to post up creations that are not your own, but at least with videos of TV shows and what not, (viaccom's lawsuit against google) but you can get around this by simply adding somethign to the video

plus if you have never noticed a lot of the music on youtube is from the producers or labels themselves. UniveralMusicGroup has like 200 videos or something rediculous of all their signed artists. viacom is just being bitches.
