Has anyone ever sued after being injured in the Streets?

probably because they could get sued...it's not because nobody does it, that they shouldn't worry about it ...

and also most people don't know what you're actually doing on their land...for a simple bystander we look like little gangasters in our tall tees and bandanas
and also if you hit a feature like a rail or jib a trashcan, it will get damaged ...
 
People sue over getting injured on the streets all the time. I live in a town built on tourism and gambling and it got so bad that their is a city wide ordinance saying you can't have any cracks in your sidewalk for people to trip over and sue the city and you can't have any ice on the sidewalk either. Shits insane. People will sue over anything and that's way they're scared.
 
cause all older people think extreme sports are the devil and can't come up with a legit excuse to kick you out so they just say you'll sue if you fall. Like you'd win that case anyway, you'd probably just get slapped with trespassing and legal fees.
 
i heard a story of a robber who slipped on the stairs broke his hip or something and sued. so you could have a decent case if you hurt yourself
 
I don't think the worry is that the individual will sue, but the insurance company going after the property owner for compensation. I don't really know if that really happens though.
 
In any injury case if the plaintiff can prove that the defendant is liable for their injury, the plaintiff can be reimbursed for his injury and then some.

1. Get injured, and a lawyer

2. Sue the property owner

3.??????

4.Profit
 
yeah but they have to show that the defendant owed the plaintiff a duty of care, which sometimes can be harder to prove
 
it's really easy to sue property owners and get away with it, people do it all the time. 9 times out of 10 they have insurance for that type of thing. the person suing asks for some ridiculous amount (like hundreds of thousands) and the insurance company gives them a nice settlement, usually 20 or so grand. sort of like getting in a bullshit accident or getting hit from behind in a car. if they even do sue, the property owner get's higher insurance rates but that's pretty much it...
I honestly never heard of anyone suing for skiing, skateboarding, etc. Usually there is someone filming and if that is brought to a judge, they could issue a warrant for the footage, in which case I could see you being fucked and not getting anything. I could imagine it being pretty hard to prove that a someone hitting an urban rail was doing it without intent and by not knowing the risks involved.

generally courts are weary to grant punitive damages for negligence claims, which is what this would be...
 
I found quite a few cases of skateboarder injuries online. Courts have decided both way on the issue depending on the court. I haven't researched this enough to decide which way most courts rule..yet...
I also found some cases where some snowboarders crashed into stuff while they were having snowball fights while snowboarding...
also found a lot of cases about suing ski resorts for injuries sustained in a terrain park...

my neighbor recently got sued because some kid was driving by in a car and smashing mailboxes while hanging out the window, my neighbors mailbox flew off the pole it was on and hit the kid in the face after he hit, cutting his stupid ass up pretty bad. his family is now taking my neighbor to court.

if that can happen, im positive some dipshit asshole somewhere has sued over getting hurt because somebodys rail caught his edge or their stairs were too sharp.
 
I'm not sure but to me seem's like America likes to sue everybody and anybody for anything, for the stupidist of little things. It's pretty lame but I guess everyone's trying to find a way to get rich to live the American dream. and I blame America for not having jumps at my rsort anymore, which is extremly sad when you ski on the east coast and there's not much snow

i have never sued after being injured in the streets but i have no trouble thinking of people who would do that
 
dont be shocked dev.. NS is a great barometer for the eyes and ears in the street. should i ask my dad, cuz he wouldn't know anything on this matter? also, the subject is interesting to me and i thought some of the other NS members would like to comment/think.
cam riley was recently injured on a street set up and the owners of the building were watching. we had gained permission to hit the feature, so the idea of suing was lessoned.
i like that i am a grown man to you DeV, as creepy as that sounds.
 
Na I just got broke off the other day. After a few days in the hospital im all good now. Just got a bit of a broken rib and my lungs are fully functioning once again. Should be back on skis any day now. It was a good tumble. Fortunately I have health insurance.
 
You should go to a lawyer or someone you trust and not ns for this advice. And i consider you a grown man because i know that you are far above the age of the avg ns'er which is like 16. I just dont know what kind of good sound advice you think you are going to get here.
 
My mother and I got into a fight debating weather or not to get a trampoline in the backyard. She gave me one rule. Dont let any one else jump on it bc they can get hurt and sue us. To this day, I never listened.
 
honestly, it'd be a good case and you'd probably get financial compensation if you had a good lawyer
