Ganja charges in Utah Advice needed ~! Park city Area

Soo I got pulled over for a routine Traffic stop in Park City utah, and they searched my car and found about 3 to 4 grams of weed and my papers.

I got locked up for 5 hours and then my friend bailed me out for 1000$.

now ive never been busted for weed or for anything, and Im facing 2 charges in Summit county one for marijuana posession ( small amount ) and drug pariphinalia ie .,. some fucking papers.

Can any one from Utah or better yet park city give me some insight into what the punishment might be?

should I get a lawyer ? and what are teh judges like in summit county?

So they randomly chose you to search your car and you let them. Now theyre using what they found it court?

illegal search and seizure...that whole law suit is in-valid
 
They can pretty much use any reason they want for probable cause and get away with it, even if they cannot prove it. All they have to say is they got a hint of a smell of the weed and they have the probable cause they need.

 
yea but i doubt they can change their police report this far in the case. it wont show on their reports, and i probable cause is only suspicion by oath or affirmation and or the exact spot or persons to be search.

So unless they clearly SEE the marijuana or phaphanelia, or someone admits they have it/someone tells somebody of an actual crime being commtied they cannot search it.
 
GET A LAWYER

i'm not sure what the rules are in the states compared to Canada on this, and i think their alot heavier, but in Canada with small amounts of weed a Lawyer can totally get you out of it.

If they smelt weed, probable cause

If there was a drug dog, probable cause

If they tricked him by using negatives, like can we not search your car, probable cause

If they saw something out in the open, probable cause

If they noticed he seemed high, probable cause

If he was drinking/underage, probable cause

If the cop wanted to search him just because, probable cause

If theres probable cause, theres probable cause holla at ya boi welcome to merica holla
 
man, you suck at the law. you are the reason cops hate teenagers who act like they know it all.

On another note, i would assume its nothing more than a ticket for probly something like $500-1000. but hey, mormons go hard when it comes to drugs, so who knows. serach the NORML website to find other cases in the area.

does any one actually live in utah and have any stories or previous times they have gone to court? ive never been skiing in this state for this very reason. Any real advice would be most appreciated.

And they smelt something that was the probable cause to search the car.

Less then a OZ can be up to 6 months in jail and 1,000 fine. If your 1000 feet from a school, park, or church when it happened then it can be 5 years and 5,000. They can also be bigger dicks and slap you with a felony for not having a a tax stamp for weed.

Good thing he didn't test you for DUI. Another fucked thing is that they can test you whenever they want to via saliva and if you smoked in the last 24 hours they can potently detect it.

They will probably drop the possession(especially if you're a student they will give you a 2nd chance as a possession conviction voids federal financial aid) and give you a deferred judgement on the paraphernalia where you stay out of trouble for a year and it goes away.
 
As harsh as he made this sounds, this will happen only if the cops a super dick along with the court, and thats assuming this isnt your first offense. But seeing as how you said it was, the harshest i would figure is a fine, very light probation for 6 months to a year, and if you were a dick to the cop and in court they will take your license for a year.

Not personal experience but two very close friends have had this happen.

Utah also passed a law recently not allowing cops to use the smell of marijuana as probable cause, afraid i cant prove besides my personal experience of being pulled over with 3 friends after blazing in a car for a few bowls. We denied smoking anything and just said no to everything, all you have to do is be polite and say no, you have your rights. Even though they smelled it we just denied and they left, even after calling in 2 more vehicles for "back up."

Once again i cant prove it, but thats my experience with cops in slc, did some stupid shit in highschool.

Why did your friend bail you out for $1,000? Seems like a lot of cash wasted when you probably would have spent around 24 hours there, likely in a holding cell and not in real jail. You're in a bad position, legal-wise, I really don't have much advice for you. Get a good lawyer, hope for the best, and try to stay out of trouble while you're on probation.

here's some interesting facts: aussies are the most arrested people on earth while visiting outside of their country. the arrest rate averages 2 aussies a day. also australia is the leading country in smoking weed.

in conclusion, you're a fucking stereotype... and incredibly stupid. why are you stupid? well... you allowed a search, get busted then you make a thread on NS asking for advice from a bunch of kids whose knowledge only extends to mute grabs and jerking off. nice going.
 
I didnt allow the search my french friend did he doesn't speak good english and was driving and was unaware of the Law , your post did make me laugh though and maybe I am a stupid and a stereotype haha shit happens. thanks for the info on aussies .. but your wrong on one thing Kiwis are actually the biggest weed smokers per capita. not aussies
 
my buddy got pulled over in slc with a roach and got charged with possession and paraphanalia, had to do like a drug class and some other bullshit and was on probation for a long time. side note, you can get possession in summit county?

Can you find a 16-20 year old kid with $1,000 to loan out, even for a short time frame? I know I can't, you stupid fuck.

I fucking lost it, but in all honesty lawyer up,this coming from someone who has possession charges/experience with this bs. It might cost you some dough. but you will not regret it. BTW I take it those are both misdemeanors, at least I hope they are. gotta love NY and the decriminalization of tree
 
oh my god that is harsh.

in ontario when the popo finds 3-4 grams on you, they write you a ticket and then they smoke your weed.
 
Congrats, that's awesome. In terms of expenses: do you pay for the house you live under? How about the car you drive? Insurance, both on your car and yourself? Food? It all adds up. It's awesome you've saved up 10,000 on your own though. Keep working hard.

being from seattle as a legal adult it's only a small fine if you get caught with an ounce or less
 
I'm facing the exact same charges except I live in PA. I got a lawyer and i'm doing what someone above me said--shutting the fuck up and letting him doing the talking haha...my court date is march 7th so we'll see how that goes.

Good luck man, hopefully we don't end up with any crazy consequences.

and also, i am fairly certain that cigarette papers do not legally fall under the category of paraphernalia, so hopefully that will decrease your charges
