Felony Hat-Trick

I know NS is not the place for legal advice but figured this would at least entertain you guys.

2 Months ago I got in a fight with a kid and my friend took his bag.

We got Charged with 2nd Degree Assault, Aggravated Robbery, and Conspiracy to Commit Robbery (All 3 are felonies). I spent 6 Days in Jail before getting bailed out (Routt County), and I had to move back to home to NJ from CO because I got kicked out of my res hall at cmc steamboat.

Today i just got my first plea offer: 10 Months in Jail, 4 years probation (deferred judgement on felony), 300 hours community service, and I have to pay restitutions for medical bills

I would be pleaing guilty to robbery (f4 deferred judgement) and a 3rd degree assault misdemeanor. If i completed the probo successfully then after 4 years the felony wouldn't be on my record.

My Questions to NS:

Has anybody else been in a similar situation?

Whats the worst thing you've been arrested for and what was the outcome?

Do you think I will get a better plea offer as the case goes on?

I mean there is always a chance for that but you can't guarantee it. You also never know what your friend is going to do- he could be offered a lighter sentence in exchange for more information you.

If you don't take the plea deal and you go to court, you have to weigh the outcomes. What are the odds you will be found not guilty (that might be tough depending on the evidence)? If found guilty in court, what will your sentence probably be? If 10 months in jail is significantly better than the worse possible outcome, then I say take the plea deal. If you think the odds are in your favor to be found not guilty, then maybe keep going and take it to trial.

You also have to consider the longer this gets played out, the higher your bill will be from your lawyers.

Listen to your lawyers. The deferral is probably the most important thing. A felony on your record will haunt you for life. Your next pre trial hearing will probably your lawyer and the prosecutor hammering out how long your jail sentence will be. If I were you I would check into counseling and go to rehab. Any bargaining chip to sway the judge in your favor. Get some upstanding people to write letters to vouch for your character. You know, scummy fake bullshit that everyone does to convince the judge they aren't a total piece of shit even though they clearly are. Good luck.

thanks for the advice. I am alreaqdy in an outpatient rehab becaue I am a "weed addict" 62 days clean
 
So you're telling me that they're going to pin 3 felonys on you for getting in a fight and stealing a kids bag? Seems a little steep, no? Is there more to the story? Was it more of a two on one beat down and the kid is clinging to life? Just seems like you should be getting a better plea?? Dunno, I'm no expert

it wasnt an unfair fight but he sustained a broken jaw which is why we got 2nd degreee

A broken jaw? Seriously? Maybe it's because I'm from Canada but I'm surprised it's gone this far. You had a beef with this kid got in a fight punches were thrown and his jaw got broken? Is he getting charged? What's your friend getting?
 
Color me stupid but that sounds like a lot of punishment for a rather mundane crime. I mean, it's an animalistic instinct to fight and we are animals. Sure, were supposed to be held to a higher more civil standard due to our advanced intelligence but that is a freaking doozy. Is it mostly the robbery?
 
Miss 1 ski season or miss multiple. Also I think the skiing part is the least of your worries.
 
Did you conspire to beat this kid up and steal his shit? Because if you did I don't know why you think you'll win and you should take the plea offer to save time, money, and possibly time.
 
lol whaaat. My roommate at school is facing 9 felonies for car hopping and he probably wont even have to go to jail says his lawyer. good luck OP!
 
Wait...are you the one who made the thread about you and your band wanting to move to boulder from new jersey, because the cops were after you???
