Faction vs KISS

that was really stupid of faction, at least the line topsheet was arguably kiss inspired but had no definitive band members on it.

I'm incredibly surprised Gene was walking around SIA.

 
dumb dumb and even dumber... idiots... of all people to mess with... dont mess with gene... or metallica... people should know this by now... be safer using twister sister for graphics..
 
I think it was 3 years ago when they first put out the anthem Line got sued by KISS because it depicted a guitarist with facepaint. Line couldnt sell the skis, that is why this year they released it with "limited edition" cutom topsheets, cause they needed to get gene off the skis
 
The article said something about how it is just a sample they did for SIA, does that mean they weren't gonna put it on the ski they sell to the public? Can he still sue the shit out of them if thats the case?
 
Shit if they sue faction...its over. Simmons was probably walking around because he knows people try to make money off him. How dumb can you be?

second, what a shitty graphic to potentially get sued for! i mean, KISS is cool and all but who wants that on their skis?

 
If they don't plan to sell the ski than i don't think there are any grounds to sue. I would be the same as if i drew a picture of him. As long as they don't profit from it.

I remember k2 got sued by Evil Knievel for the Stuntman graphic like 10 years ago. The had a little picture of him doing a wheelie on a motorcycle on the tails. half way through the season the picture disappeared from the ski.

Gene Simmons is first and fore most a business man and will capitalize on anything and everything that has to do with KISS. I've heard that he owns the copywrites to the term "OJ". So sending him a ski with a graphic that looks like him is like sending him evidence for a suit. Keep Gene Simmons out of SIA for the saftey of the ski industry.
 
Hi guys,Tony from Faction here - just want to say thanks for all the comments. The skis look sick and we're pretty stoked that Gene has seen them - hopefully this means we can get the skis produced...personally i cant think of anything better than a 194 rockered, stiff pow ski with Gene's stage make up across them - but we'll have to wait and see after discussions with his agent.
We've had a TM lawyer on this from the start, so we're hoping for a good result.... even if we cant use this graphic the ski will still be out and it rocks!

He is actually working with some company that sells ski accessories called Moneybag. Don't ask me about the company; I read about this in the New York Times.
 
Yeah.. when I showed up the first morning of SIA and saw those as I was walking around, I was kinda dumbfounded - "Gene Simmons sues line skis and then he allows faction to put that on theirs? wtf"

20 mins later I heard Gene was walking around, saw the ski, and is now suing faction..

 
perhaps one of the sickest graphics ever to grace a ski. sooo undeniably sick.
gene simmons is just a business man, and he is also very very stubborn. he knows what he wants and he will get it. faction are staight up fucking idiots to do that. seriously. you dont think taht gene simmons has someone looking at skis and snowboards, and skatedecks, anything with his face on to rip off the face. the article does say they just printed the one ski as a demo but i highly doubt that. they are gonna get fucked haha.
 
Definitely not a smart idea to ever do anything KISS related without paying for it, because either way you will in the end. I'm pulling for you guys though and really hope that you don't get anally fucked here
 
they didn't take them out they just put a new graphic. If you take some athem EP special edition and take off a bit of cosmetic you can see the old kiss graphic.
 
This is hard to believe. I can't believe another company went down this same road. They are clearly going to get sued.
