A bill that has just passed the California State Senate could effectively make criminals out of many people- just for having sex.

The bill, SB 967, would require “affirmative consent” before college-age couples can have sex. This would essentially outlaw sex that is had “while in the heat of passion”.

Thoughts?

But does affirmative consent= signing a contract, or just saying yes?

I see where they're coming from. But I don't see why they need a law about this. If a girl or guy says yes, drunk or not then that's his/her decision. It's not a crime to have sex. Rape and sexual assault is one thing but having drunk sex where both people say yes at the time is not a big deal. Im not signing a fucking contract everytime I want to have sex. Fuck this shit.

I agree instead of making ridiculous laws like this why not make rape sentences harsher. Also in cases where girls have buyers remorse suck it up(Not saying every girl who gets raped is just having remorse[a small percentage of people actually do this] for their actions there should just be a way to punish people trying to ruin other peoples lives because they are having a case of "Buyers remorse".)

Yeah I agree. Also, someone who drinks and drives is held responsible for their actions while they are drunk. Why can't a girl who drunkenly says yes to sex be held to the same degree of responsibility?
 
And anyway, the NSA could pretty easily find out if it was consented or not, I mean they do have brain scanners installed in all of us

I think there is a happy medium. As a former frat prick, I saw girls get taken advantage of when they were basically incoherent. That's not right. It's also not right for two people to have heat of the moment sex, whether alcohol is involved or not, and one of them wakes up in the morning with a case of the regrets and claims rape after the fact.

I think the problem with the drinking and driving analogy is that two activities are involved. You can't just say girl get's drunk and girl goes to party, therefore it's OK to have sex with her against her will.

I feel bad for you guys if this is adopted by other states, which I am sure it will be. Every day this country becomes more and more of a nanny state. Pretty soon they'll start fining girls for wiping their butts from back to front because it causes urinary tract infections, which increases healthcare costs. Can't have that can we?

I agree that people shouldn't use roofies(Flunitrazepam), or get someone black out drunk to get what they want. I wish there was a way of charging people for using them to have their way with a girl/guy it's just like someone raping someone else IMO. It's only OK if say the girl/guy wants that(Some people are into that kind of thing). There are a lot of factors that should all be accounted for rather than one law that doesn't take into account that people have certain kinks that they enjoy(Who are we to judge what people do in their bedrooms).

Also there is no such thing as a person not having the ability to contain their most primal of urges. People do it all the time.

The drinking and driving analogy is relevant because someone who is drunk is still held accountable for their actions in a vehicle if they hurt someone. They are "consenting" to driving while drunk. It seems like current laws say that sexual consent cannot be given by a woman if she is drunk because her judgement is impaired, which is analogous to saying that a drunk driver can't be punished for driving drunk because their judgement was impaired when they got into the car. Current laws make it really easy for a girl to claim "rape" if she regrets consensual, drunk sex because her consent wasn't valid in the eyes of the law.

Im pretty sure youre not actually required to sign a contract, just to make consent explicitly clear. I am not sure what exactly this accomplishes without a witness or some other intrusion in to the involved parties privacy, but it certainly isn't as bad as that article is making it out to be.

I get what theyre going for here, but there can be some pretty clear non-verbal consent. For example if you grab my dick, point it at your vagina, and sit down on it im pretty sure that's equivalent to agreeing to have sex.
 
You realize it takes two people to have sex, if before parties have been drinking, then by your logic both are at fault. What if I'm at a party I've been drinking and go home with a girl who was dding for her friends is she now at fault?

You hear a lot of people with DUI's making excuses, exonerating themselves, in the initial period following the incident, but with time many see the error of their ways. However, quite a few will go on with their lives never learning and repeat offenses occur.

Not sure legislation was the right way to go about this. It should be addressed in health class or in an education setting. Teach what is and is not consent, and what not to do if you regret it.

I think I've voted 3 times and I've been registered to vote for 7 years. I refuse to vote for idiots. Unfortunately that means I pretty much can't vote

That's another concept that I don't understand. That it's your "duty to vote". It's push in 'murica at least. If you don't have any idea what the hell is going on you may have the right to vote but you probably shouldn't be. Voting is stressed hard as fuck. Being informed about any of the candidates, issues or even what galaxy we're in, not at all.

but without a law how do you define consent, how would you know if you regret it if it is not deemed wrong?

No they push it here and people who don't vote are criticized and are told "you have no right to complain if you don't vote." Which I don't believe is right at all. If I don't want any of the people in the running to win why would I vote for them?

This so much! If all the choices are fucking horrible it's stupid to vote for one of them. You can't progress by electing shitty people just because they were the slightest bit better than some other douche.

The other problem here is the party situation. Even if somebody good runs that is perfect in every way, if they aren't back by the 2 main parties they won't get anywhere. A good amount of people just vote for the candidates supported by the major party they aline with.

You will actually have to have your dick notarized before you can have sex, but not just any notary will work. You will have to visit a Notary Pubic.
 
The article says consent can be revoked at any time... Do you need to sign a contract every 30 seconds of sexual encounter?
