So my roomate/landlord is evicting me because i had a party at my place with only five people altogether but i decided to drink an entire litre of Jack Daniels in under a minute and we went into town to do some stuff so the actual drinkin at my house was over by 330pm and when we got back was when everything went down and the old coupl who are my neighbors called the cops because we were bein too loud and my roomate didnt even see me or the party it was all over by the time she got home but said i flatout disrespected her by having the party there...my roomate is a hardcore devote christian who is only 26 and thinks she knows everything about everything in life....anyways her brother and father the next night before i got home at 930pm had all of my stuff out in the driveway and tried to tell me that i couldnt come in the house and had to take my shit and leave! So i called the cops and had them tell them the law on eviction and the cop told them to put all of my stuff back in the house and instead they just put it in the garage im fuckin pissed because ive never done anything wrong to her before always paid my rent and bills and always kept the house clean even after i partied i had it lookin clean and now she tries to just dump me out on the streets 6-7 months into the 1 year lease!What the hell should i do besides look for another place obviously?

If you are 21 and all the guests were 21 and there was never anything signed by you saying that you wont throw parties, take them to small claims court to get your security deposit back plus if there are any immediate costs associated with moving, i.e. truck, deposit on a new place, etc... but this will only work if you dont have a signed contract prohibiting such tomfoolery. if people were under 21 i doubt you have much of a case at all, as they would be aiding and abetting if the cops chose to be that way.

 
well they have no proof so you should be fine

You can win this case, but just don't be too loud in your apartment or whatever it is from now on. You'll be fine, the evidence is not against you.
 
they can kick you out for whatever you want, but notice must be given to the other party within 20 days of terminating the tenancy or it continues through the following month.
 
Nah man.....i think you fucked your self. I believe there is a clause in most lease contracts that pretty much tell you that they can evict you for whatever they want. But the thing is, to do so they have to give you a notice, and go through a system which takes a few days. Your in the wrong for the party, and would lose in court for that. They were wrong in just throwing your stuff on the street and telling you to just leave. What you need to go is get a lawyer ( if you've got one or can afford one), and get them to tell your landlord how its gonna work.

But your pretty much not going to get your place back, and you need to find your self some new digs. Good news is your will probably have a few days to do so, and since your posting on NS from any sort of computer i think your situation is not that bad. But dude, why would your throw a party at your place....and you live with bible thumpers? You were pretty much askin for it.
 
get a lawyer, when you win, which you will, my dad went through this same thing when he was in college, they will have to pay your lawyer cots too.
 
The very fact that you're asking for advice on NS tells me that you probably didn't read your lease, which probably means there's an eviction policy in there.

I've got a real nice cardboard box you're welcome to for the time in between apts though...
