Drug Citation Help

Hey guys so I got a quick question if anyone can give some personal experience or legal advice.

So my friend at college was smoking in his dorm room and the cops got called. They told him that it smelled like weed in his room and questioned him a lot. He denied everything and they didn't find anything in his room.

So the other day he got a notice that said he got written up for possession of an illegal substance. \

So he is wondering if they can actually cite him for possession based upon a smell and the fact that he looked high.

Any advice would be sweet.

It does because of the lax laws toward mary in MA. They can certainly issue the citation, however if you put any fight at all towards it you'll beat it.
 
Deny deny deny. They smelled weed in your room? It was probably the neighbors on either side, you don't know where it came from, you're a victim. How dare someone's sick drug habit put you in a situation in conflict with law enforcement and contemporary moral standards!
 
At first it sounded like the police wrote him a citation but that's not how they operate. He would have had to be arrested and then formal charges would be filed later or not based on evidence. Its the university that is citing him, which any person of sound mind would 100 times rather deal with their RA than the cops. Tell your friend to buy some drier sheets and make a blow tube, and be grateful he doesn't have to go to court. And in the future always blame it on the neighbors.
