i gave google a try but i just don't know how to work the damn site and can't figure out good keywords so just fuck that.

anyways does anyone know if you are questioned on the street or something and not under arrest but the police officer asks for ID, do you have to show him? i'm pretty sure you have a right not to but what the fuck do i know.
 
well obviously if you have nothing to hide it is. but in decriminalized states etc. since you aren't under arrest it could come in handy as far as lying about your name or something and refusing to show ID could help. i'm not sure how much sense i'm making right now.
 
The harder time you give a cop, the harder a time the cop is going to give you. If you have nothing to hide, then just show him, make sure you know your fake well. haha.
 
I can't help you with your question but I read something cool today.

When stopped by a police officer, they have the right to pat you down to make sure you don't have a gun, but they can not make you empty your pockets unless they have probably cause. I never knew that before.
 
that's interesting. it just really sucks that they can easily abuse their power and all it takes is a simple "i smelled marijuana on the person" and they can do whatever they want pretty much. even knowing your rights can only get you so far when the law can be bent and twisted to whatever an authoritative figure wants it to be.
 
Marijuana scented candle. Keep one wherever you keep your bud. If a cop says he smells weed just tell him you're just burning a candle.
 
They can take you to jail if you do not have proof of identification in California. i do not know if it the same in other states.
 
I don't know if you have to show him an ID because there is a good chance you might not have it on you. You are required to tell him your actual name and other basic info that would be on the back of that car.Lying about those things is quite bad.
 
I read somewhere on a legitimate website that you dont have to legally show ID unless you are being arrested or otherwise detained. I rarely ever have my ID on me unless Im driving. Usually when I drink I just ride my bike to eliminate the chance of a DUI and eliminate having an ID on me at a party.
 
in idaho If a police officer approaches a vehicle and suspects that the occupants are engaging in sex, he must either honk, or flash his lights and wait for three minutes before approaching the car.
 
just let them see your ID is your name that big of a deal? when it comes down to having yourself or your car searched thats when you need to put them in their place. if a cop approaches you for no reason which happens pretty often, they can only pat you down for weapons if you step out of the car. unless they have probable cause they cant search your pockets or your car even though they will probably ask to. be polite and respectful and tell them that they cant and to fuck off
 
yeah. its the stop and frisk law. yeah he can randomly stop and pat down anyonee. but say he pats too long. or is feeling around at something in your pocket or reaches in there, anything he finds wont be valid in court because his search was illegal and too extensive.
 
i know in mass if you get a ticket you can lie to the officer about your name for some reason that i forget, i think i read it on some news website so google it
 
thats only if you are stopped for weed and nothing else. my econ teacher told us that one day so i know its legit that you can give a fake name and not provide ID in MA
 
What state are you talking about? Every state is different and if there is a state like that that is pretty fucked.
 
At least for driving a car I know it is illegal to not have an ID so if you are pulled over driving your car either you get a ticket for not having it and end up giving him your name later or giving it to him at the time. Basically, dont get caught being a fucking idiot and you shouldnt have to worry about this.
 
You can get a OVI (which is what they call DUI's nowadays) when driving ANY vehicle. That includes riding bicycles, rid on lawn mowers, cars, etc. Just a heads up, you might be better of just walking or taking some other sort of transportation when partying.

Every state is different. For example in Montana you can get 5 DUIs before you lose your license. No other state is that lax on drinking and driving.
 
Lets just say that youre running from the police and they tackle you. Obviously the frisk you, but at this point do they have the right to make you empty out your pockets or reach in there?(no homo)
 
Uhhh I'd assume pretty much instantly. If you run from them doesn't that give them probable cause that you're doing something you shouldn't?

I'm pretty sure if you run you don't really have the option to say that they can't search you. I was mainly talking about if and when an officer happens to stop you on the street or at a bar or whatever.
 
If a police officer requests your ID you have to fork it over. He can say you are being temporarily detained for questioning for [insert suspicious activity here], and a failure to do so could result in [insert law here] (obstructing justice, messing with a police investigation, refusing to obey officers orders).

And yeah it only starts you off on the wrong foot with the cop.

All he has to say is a 7-11 was robbed and you fit the description. My friend had a tan Chevy Blazer, he got pulled over for no reason other then "another vehicle fit the description that had been stolen" and he was pulling him over to just make sure everything checked out okay.

 
Remember this is mainly New York City that holds policies like this. It's not representative of how all of New York State enforces Pot Laws.
 
what about if your in a different state do cops go harder at getting you in trouble like i was in fl and im from pa at a party that got busted i dipped out but my one friend from pa got caught he just gave a fake name and said he was 18 and the cops didn't do really do anything...seems like cops really don't care there
 
Yea i got what you were saying I just had another question that sort of linked off of your statement. Thanks for answering that though. Haha your answer makes more sense then what I was thinking.
 
From my experience, cops really don't give a shit where you live. Last Thanksgiving I got arrested in St. Louis by some jackass local cop, for trespassing no less. Luckily I got him to give us a summons instead of hauling our (19 year old) asses in to jail on Thanksgiving day (it was like 1 in the morning). But I'm sure it really depends on the area and I probably just got a dick of a cop.

But watch out for simple, non-arrestable things when you are in a different state. If a cop can give you a ticket for anything, they will. Because they know you're just passing through and it's not like you'll come back to contest the ticket. You'll just pay the fine and the city/state just made a little bit of quick easy cash.

See our country has decided to create irrational policies that crowd our judicial systems with non-violent offenders. People who do no harm to anyone but themselves or others who agree to the harm (read: prostitution, gambling, drug use, etc) These people are arrested by the millions each year. Most police stations and court offices can't handle the sheer amount of people being arrested so they issue you a summons to come to court later down the road so they can control the number of people being arraigned, indicted, etc at one time.
 
Ya the Montana Association of Bars or whatever its called has some pretty big lobby power. The average male in Montana drives drunk 530 times before getting caught.

suspects who refuse to identify themselves.

Regardless of your state's law, keep in mind that

police can never compel you to identify yourself without reasonable

suspicion to believe you're involved in criminal activity. Rather than

asking the officer if he/she has reasonable suspicion, test it yourself

by asking if you're free to go.

If the officer says you’re free to go, leave

immediately and refrain from answering any additional questions. If the

officer detains you, you'll have to decide whether refusing to disclose
