first off, you dont actually have to hit someone fora charge such as assault.
intent + capability + starting the action = assault
when you actually hit someone it then becomes battery
plus rewind several times and zoom in. you can see the cop move in front of the car, the guy then moves the car. the cop tells him his foot is there and then butts his foot right up against the tire. zoomed in, you can easily see the car pull up even further, likely getting on top of 1/4 to 1/2 of the cop's foot where he was able to pull it out
