Can a school really search your car?

So here is what happened. My friend ditched a class today while I have a free period. He was called into the office (we where sitting in the commons area) and was told to sit in the principals office. This isn't his first time ditching this class either. Anyways, he decides to just walk out so my other friend, him and I all walk down to the Junior lot where my car is parked.

We get in and I back out and go to pull out and the security guard blocks the entrance with her car so we can't leave. She comes over to the passenger side of my car and starts talking to him. She told us that the school police officer was coming down to get him. The officer pulls in behind her car and my friend gets out. He walks over to the officer who grabs my friends arm and starts to roll up his sleeves on his jacket to search him. He then pats him down and puts him in the back of the cop car. They drive off and I back up and park my car.

I get out and decide that I want to put the weed that is in my jacket pocket into my car. I grab a pair of shorts I have in my car and begin to take the bag out of my jackets chest pocket. As I am about to take it all the way out I look up on the hill side where there are a set of stairs that take you to the school and there is another security officer watching me. He was probably about 200 or 300 feet away.

I never actaully took the bag out of my pocket so all he saw was me reach in, look back and see him and then take my hand out and zip it up.

I quickly took my hand out of my pocket, zipped up my coat and then grabbed my back pack. My other friend got out of the car and we started walking up towards the security guard, the only way back to the school. We get to him and he asks us what we are doing, I tell him that we just got back from lunch and we have a free period. We are just going up to the school. He asks me what I have in my pocket of my jacket. I told him I didn't have nothing and my friend responds with its just his keys.

He says that because of what he saw he has propablecause to report me to the school officer and have me, my backpack and my car searched.

Can he actually have my car searched because he thought he saw something?

He was really cool about it but it just didnt seem like he has enough evidence for them to search my car and I.

Forgot to mention that when I got back to the school I flushed the bud down the toilet. My friend offered to hold it for me but he was in the car also and I figured that if they search me they would search him too since he was in the car and I didnt want him to get caught for my shit.
 
In this case, yes. The security guard may search you and your car if you have been spotted handling illegal substances.

But why the fuck do you carry weed around you on school property?

 
He didnt see me with anything though, just saw me put my hand in my pocket, look back at him and take my hand out quickly.

I dont take my shit to school but I just bought some in the morning today so I had no choice other than carry it with me.
 
If a cop had probable cause, then yeah - i don't know what powers your school security guards have to search though?
 
for some reason i have the feeling that at school all your "rights" are kinda thrown out the window. i don't know where i heard this, or how it applies, but thats what i heard.
 
Thats not cool. The US is so much stricter than our schooling. No security. I couldn't believe that some US schools have metal detectors!!
 
If your car is on school property they can search it. Off school property no chance. But since you were on school grounds you definitely coulda been searched.
 
basically what ever you have on school grounds is open for search by cops and the school you have like no property rights at all....
 
yep, you lose your rights to about everything. i had my locker searched about 10 times last year because some kid turned in a "drug dealers" list. fucking bitch never did find out who it was. and if i ever took weed to school i would hope i got caught, that's so retarded. but in school or on school property they can search anything basically, you lose your free speech rights and all kinds of shit. it's gay.
 
since you were parked in a public parking lot they can. At my school a ton of kids got busted because they took dogs in the parking lot and searched cars.
 
If it was a cop he can because he is an official extension of law enforcement. A security guard sure as hell can't even search your coat, let alone your car.

A security guard has no more legal right to detain you than your friend does. If they do try to detain you, you could actually bring a suit against them for the tort of arrest (not to be confused with getting arrested). If they search your car and find weed, that can't be used as evidence in any trial or court situation because it was attained in an unlawful manner.

Cops can search for probably cause, Security guards can't even lawfully detain you.
 
Didn't read your post but in 99% of cases, you lose all rights on school property and get fucked in the ass. If it's a security guard you may be able to get away with the search, don't know for sure, but he definitely has the right to get your ID and name so that he can fuck you over later. Don't be stupid on school property is the moral of the story.
 
you need probable cause to get searched but the way our school system works it really doesnt even matter what you say or do. Its pretty retarded
