"Best Friend" screwed me over

Notice: i know driving is dangerous and i admit that i was dumb and wrong for racing my car.
so me and my buddy were driving in our cars when he went to pass me, so not going to be out done by my friend i sped up, and we begin to race. We get to like 80 mph when i see a car coming, i am in the correct lane and he is the opposing, and we are side by side. So i brake to let him back in the correct lane, but he doesn't move, so i honk and notice that he is just smiling at me, not paying attention to the car approaching him head on. Then he turns forwards and gets his car out of danger, but as he changes lanes he slams his brakes and i dont have enough time to slow and re-end him. Totalling both cars, so i tell him he is a moron, and start freaking out, when a cop shows up. So i go to tell the cop what happened, but my friend cuts me off and starts telling the story, but the cop wants only one speaker at a time, and grants my friend the right to tell the story.
This is what he said.....that he went to turn and i just slammed into the back of him, as if i wasn't paying attention.I'm try to tell the cop thats not true but i cant prove it, i did re end him, but it was equally both our fault, not just mine.
The cop believes him, so now i have a huge fine, 10 points on my license, and no carwe are going to court, i just cant beileve my buddy would do this to me, we have been friends for ever
 
well he can't prove what he said is true over your story either. from my point of view i think it would be much easier for you to rear end him if he slammed on his brakes.

I think i can porve that we both were moving fast cause if he was stopped and i hit him there would have been alot more damage. Plus i think there were skid marks from him merging back over
 
If you hit someone, 95% of the time the person in back is at fault. Seems like an unfortunate situation and your friend is a douche for slamming his breaks on
 
that guy is a def a douche but i think you may be better off just leaving it as it is. Cause you both were technically racing and i am pretty sure that would have a much more severe fine/punishment. But i may be wrong...
 
well he lied to the police, so if i can prove him wrong, ill only get a small fine, and he will get community severice along withe a monster fine, for lieing. thats my lawyer's thoughts, plus judges are eayier on people who can prove their honesty.... i hope so
 
yea but if the truth comes out which im guessing will if you actually go to court you both were "racing" and both parties are going to be punished. Yes your friend may have a more severe punishment for lieing but your also going to be shooting yourself in the foot cause your new punishment is gonna be super shitty. But im not a lawer so listen to yours over anyyone in this thread, but make sure he knows the full story of what happend.
 
yeah i get what your saying but, he is threatening a charge of Reckless Driving, and sueing for his whip lash when i have a broken leg and a messed up back from all this shit
 
Ok, so no one knows your were "racing"

tell them you were both going the limit, your asshole friend pulled up next to you in the wrong lane. you slowed down to let him back in as an oncoming car was approaching. he came in and then slammed on the brakes which caused you to rear end him

who ever said it is right, if you rear end someone, it going to be your fault. but i think the punishment seems extremely steep. if you prove that he really caused you to rear end him, you probably wont get nearly as much of a fine or as many points.

but remember. no one clocked you going 80. you were the one in the correct lane, you were going the legal limit (cough). admit you were at fault for something though. thats key to them trusting you. when i punched a kid in the face at school, i straight up told the principal what happened and we both got a day suspension when i should have probably gotten 3.
 
Maybe you should call him up and ask him if you guys can come to some sort of an agreement over the whole situation?
 
im pretty sure they can tell how fast you actually were going by the length of the skid marks that are left.... so that could potentially backfire bad.
 
that is the shittiest thing i have ever heard. jesus christ you're "friend" is the biggest asshole in the world. That is honestly just unreal. Call him up, try and come to an agreement. You may get nowhere but you have nothing to lose at this point.
 
Reckless driving will be more than 10 points. If they nail you for reckless or racing, you will maybe not even have a DL. Just take what you get and ask your driend what happen.
 
just be happy the cop doesn't know you were racing, shit like thats gets your liscense suspended and trust me you don't want that. just don't have your friend show up to court, and deal with it under the table. i didn't read any responses to this thread in order to save myself some time, so my sincerist apologies if i've repeated things already stated.
 
that sucks man. tell him that he needs to split the bill with you or your going to kill his parents and feed them to him
 
oh shit this reminds me of some pro on NS who went on some court sho when he was younger and won his case. anyone recall? I wanna find that video again, it was on youtube i believe.

but thats so shitty man, so your just gonna say your buddy slammed on his brakes in front of you? I think this may wind up to the truth as in you both racing and getting fucked more but good luck and keep us posted. get some pictures of those skis asap.
 
not really, like i haven't really had i chance to tell my side, im the defendant in court, he just got in trouble for wreaking his pops car
 
Dick move on your friend's part, but he's just looking to cover his own ass and knows that his story will beat yours, considering you rear-ended him. (not re-ended....)
But you know what? GOOD. Better you and your buddy get into shit/totaled cars etc. than your 16 year old asses killing someone out there. I've seen so many retarded kids racing and just being reckless in general....innocent people die all the time because of this (I've been affected by this personally on more than one occasion).
So yeah...I guess you buddy "out-did" you once more. No sympathy here. You should have been the bigger man and let him go.
 
no matter what, because you rear-ended him its going on your record regardless of what happened. if you tell the court you were street racing thats like a huge fine and like a fucking year without a license so what he said could have saved you...in a really d-bag way
 
ehhh, i dont think its really something you just "let go" and be the bigger man. i mean you get accused of a murder your best friend did. you dont just let it go and be the bigger man
 
I meant that he should have initially let his friend go when the race started.
At this stage of the game though, I would be pissed as well. The OP will and should be fighting this. They're both equally at fault.
 
Bottom-line, the driver in front is VERY rarely at fault. No matter how hard someone stops, it is the following driver's obligation to maintain a safe stopping distance between the two vehicles.

 
yeah. you're going to end up fucking yourself over in the long run. take your 10 points (which seems high, i really think that will be lowered in court) and try and keep your mouth shut. you don't want the 80mph street racing to come into play. then shit will hit the fan.

i had tickets for 50 over the speed limit, reckless driving and something else all in one and i would have had like 18 points on my license. plus suspended until i was 21, partially because i am under 18. but i got off with 4 points and a $150 fine. fuck yeah for my dad being the main campaign official under the magistrate official i went to. lucky as all hell.
 
oh and then kick your friends ass for fucking you over. you both should have agreed on a story before police arrived and stuck to it. your friend is a dick. beat the fuck out of him.

and also i say just appear at court dressed well, and agree with the kids story. say that he hit the brakes suddenly while you were checking your mirrors and you didn't have time to react and couldn't swerve because of oncoming traffic. apogolize to the court and your friend for the damages etc. i think this is your best bet, but maybe not.

Also, if it can be established that the front driver was at fault, he can be indicted for insurance fraud.
 
your gonna get into more trouble if you bring up the fact that you were driving reckelssly im not saying you shouldnt try to prove he forced you to rear end him but its really up to you to decide based on if they can tell anything from skid marks, any witnesses etc., if not, just go ahead and take wat you got, wait 3 months then kick the shit out of your friend

and yeah that sucks man, hope everything gets worked out, we all do stupid stuff sometimes.

just next time you wanna run him dont do it on a two-way road....
 
Update:
Apon investigation, the cops said were traveling at 55-60 mph (with in the limit) I agreed with this, also they said that a car was in the wrong lane and cut back over, right before the contact was made. I told them that he attempted to pass me, (in a no passs zone) when another car approached, so i hit my brakes to give him space to pull over, leaving the skid marks in my lane. Apon merging he slammed his brakes, ( the reason for the other skids) leaving me no time to react, and than i hit him. The investigator told my lawyer and the cops that the skid marks do confirm my story.
My "friend" is under investigation for unlawful confesion, and reckless driving.I have no charges at this time, and his family has dropped there case against me, we are not going to sue for damages, for two reasons... 1) the story right now is good for me, so lets not shine more light onto it.
2) Insurance (his) is covering it all.

And for those who wondered...My car was a 2009 VW CCAnd his was a Dodge Stratus
 
good. glad things are working out the way they should. how often did you hang out with this kid ? like i couldnt imagine even any of my casual friends doing this to me.
 
good to hear man, at the least it seams youve learned from the situation. any pics of the cars post accident? it takes a lot to total a brand new car so there musta been some serious damage.
 
will the frame got all screwed up, and the engine was ruined. Plus it was a lease, so i just get a new one, and insurance covers it all. I have no pics but the po-po does, so idk if i will ever see them
 
we hung out a lot more when we were younger but will still talked a fair amount. It was the first time we had done anything together in atleast 3 months. (we were headed to a grad party, we happened to met up at by another, so it wasn't planned)
 
i wouldnt use the term "racing" or tell them straight up that you were going 80 unless that comes out some other way. just say you sped up jokingly and then let him back in cuz you saw another car coming.
