Anyone in Spokane, WA want a free car?

quick description: a guy I worked with in ND had a girlfriend, she 'bought' my car by agreeing to pay 200 a month for 10 months. A week later they disappeared back to Spokane. I have the address of her dad, where I assume she lives since she's too strung out to even afford her phone bills.

Short story shorter, at this point I want to help out a skier in need, since I have no hope of ever getting the remaining 1800 for this car. If you are in the area and are a badass, we can switch the title to you and you can repo it yourself, and your only cost is to transfer the title.

Mind you, I don't know what condition it's in since I haven't been able to contact them for 6 months. so here's my car when I had it almost 2 years ago:

So the catch is you have to repo it yourself? I have a little brother that is looking for a car... Give me some details and I might be able to make something happen, I live 1.5 hours south of spokane ...

I have no idea what kind of shitstorm you might expect, but I do have a key that will get in the door, but not in the ignition (made a key copy before I sold it but it has too sharp of edges or whatever)

The people that took it are the dirty skater kind kids that don't actually skate (know what i mean). mostly drugs I think.

Put it this way, the dude got kicked out of his ND apartment for not paying rent (while getting over $20/hr oilfied work) and they have gone through 3 phone numbers while I've known them.

My plan: send somebody the title and key to get in the door, they snatch it on the sly, we all win and they lose

I don't care about the money, it's the potential lawsuit when they crash it and abandon it and it's pinned on me. Or run drugs, and suddenly I'm the cartel
 
If bakerpow doesn't work out I have an apartment full of dudes who are all stoked for some spokane adventures, just ran it by them and we will go to great lengths to obtain this vehicle if the original repo man runs into trouble..
 
so how do you expect to start it without a key to the ignition? seems like a pretty big flaw in your plan..

Is it manual? Can we get it into neutral or something? This is gonna be real hard without a key...

ask for neighbors phone number

tell neighbor story

ask neighbor to call bakerpow when car is in driveway.

bakerpow gets into car neutrals to different street

call tow truck

bring car to nest

get key copy made that works in ignition

Also, read up on what kind of car it is. Break a window, pop the hood, pull the fuse to the alarm and read up on how to hotwire a car.

I used to accidentally lock my keys in my old truck and with a coat hanger I could open the wing window, open the door and pull the fuse for the alarm all in like 10 seconds

If someone does repo it you better have all of the paperwork on you to prove that it's a legal repo or your going to get arrested. Speaking from experience, If you do have all the papers, you might want to get a friend to call the police as a neighbor saying you are watching an auto theft. I don't know about the laws in Washington specifically but in Virginia, if you have possession of the car (Access to the inside and the ability to start the engine with a key) and the cops show up they will just ask you for your papers and if everything checks out they have to let you drive away. Making a fake call to the cops definatley makes it more safe and you wont have to put up with the debtor for very long as the cops will deal with them as long as the papers check out.
 
holy uproar, to answer someone up there, I tried reporting it stolen but since we had agreed to a payment plan, I would have to take them to court.

I don't know about the legality of just taking it, but can't I effectively "sell the loan" to somebody by transferring the title to them, and then the chick basically owes them instead of me?

I should have multi quoted but I wouldn't be surprised if they did do the lost plate thing and steal it right out from under my nose

pardon my negligence but there is repo paperwork? what if the title is clearly in the repo-ers name?
 
google streetview says its there, apparently they even worked on it? stripped it for parts?

I seriously need some help, is this legal enough? can the new titleholder just go take "their" car?

I don't have an ignition key, just a door key. it IS a manual though.

or screwdriver key.

A new ignition switch for it is $20, just fyi.
 
Don't know about the other stuff but the key should be no biggie, it is usually just a VIN and Phone call away

Does anyone know if I'm legally allowed to go take my car back if they only paid a small amount of what is due?

btw I actually sold the car for $1600 total, and gave her a bill of sale that said she can register the vehicle in Washington, while the title will remain in my name until full payment is made. what did i do to myself

I'm not a lawyer, but my opinion is:

If you had a contract that stipulated they make payments until paid off and terms were listed that non-payment would void the contract you should be able to take it back no problem.

If you gave her a bill of sale saying it was paid off then you're fucked.

You probably need a lawyer

The bill of sale says, cut and paste minus the name:

"Form of Payment: Monthly payments until $1600 total has been paid. As of 3/2/2014, $400 has been paid and $1200 remains to be paid.

Warranty: Car sold as-is with no warranty.

With this Bill of Sale I authorize [name] to register the above vehicle in her name in Washington, whereas the Title for Motor Vehicle will remain in my name until the full payment has been made."

this is the last contact I had with her other than a text that said "hey can you lend me the money to renew the tabs, and we'll just add it on to what i owe" which I didn't reply to.

should I send a letter to her dad's address saying something like 'this is my last attempt to obtain payment for the car before I take legal action or repossess my shit' or something
 
Might as well get them a notice that says appear in court or give me the car back. They might decide court is too much of a hassle and just give the car back. Try threatening them with legal action, that's usually enough to get people to act.

that's what we were thinking, I'm waiting on a response from a ex-state police that I forgot I knew, ha.
 
Yeah. Only thing is if they did part it out or otherwise render it useless, I'm not really sure what would happen. Cause they'd probably give it back to you, and it'd be broken. Gotta make sure you say you want the car, working, back in your possession or something lol. or at least money.

seeing that it sounds better for your case but there's really no stipulation for what happens for non-payment. i'd say it should be implied that non-payment or failure to make monthly payment voids the sale but who knows what actually flies in the legal world. probably best to get true legal advice before unleashing a bunch of 12 year olds to pick up your car and carry it home (jokes)

there's gotta be a lawyer on here that can point you in the right direction. maybe contact a real repo company and see what kind of reaction you get. sorry man hope it gets worked out
 
I'm waiting on my excop guy and see what he says, probably going to send a letter out demanding the car be paid in full (or something like that) or returned in the same condition it was sold in..
