He's also coming around the choke of a rock/nose/tree outcropping where he clearly should've looked uphill as he was going completely lateral in a blind rollover in the terrain totally invisible to anyone above....on a 40 degree plus, piece of natural "extreme terrain". That guy was a dipshit and is lucky no one fucking died. He may not have been liable in the sense of the to the letter interpretation of the skier's act, but in an advanced piece of terrain like that, it's a reasonable expectation for someone to know better.
